JAKARTA (MKRI) — Yapen regent-vice regent candidates 4 Yuhendar Muabuai-Yotam Ayomi have filed a petition challenging the election results to the Constitutional Court (MK). The independent candidates alleged that a legislative election results dispute that the KPU (General Elections Commission) had not settled had been the root of structured, systematic, and massive (TSM) violations in Yapen Islands.
“I feel that the candidates registered and the nomination [of independents] outside political partiesare not yet valid because the KPU has not resolved the issue of the legislative election results in the Yapen Islands Regency, and there has also been a petition to the DKPP (Election Organizer Ethics Council) and Bawaslu (Elections Supervisory Body),” said Muabuai who came to the Court in person on Tuesday, December 10, 2024 with his legal counsel.
He explained that in the 2024 legislative election results dispute decision pronounced last June, the Court had ordered the KPU to recapitulate the votes by first comparing the C-result forms with the subdistrict D-result forms and the regency/city D-result forms. The Court then ordered the KPU to combine the re-recapitulation results to the results of the Yapen Islands Regency DPRD (Regional Legislative Council) election in electoral district 1 that were not canceled by the Court.
He alleged that the KPU has not resolved the issue, so it has an impact on the nomination requirements for regents and vice regents endorsed by political parties. He said this problem certainly tarnished the process of the Yapen Islands Regency gubernatorial election. In addition, he said, there had been other election violations such prohibition against him from attending recapitulation at regency level. He also said that a number of voters, including his family, had not received invitations to vote at polling stations (TPS).
“I am a [voter] who wanted to join the [plenary recapitulation], but I was not allowed to. This means that they were prepared to commit bad things,” Muabuai said.
