JAKARTA (MKRI) — Legal team of DKI Jakarta governor-vice governor candidates 1 Ridwan Kamil-Suswono (RIDO) came to the Constitutional Court (MK) on Monday, December 9, 2024. They consulted the Court on filing a petition challenging the election results.
The team’s representative Faizal Hafied said that they had consulted with the Court on the deadline and procedure to file a petition, which he revealed had been 97 percent complete. He also said that the team was preparing various types of evidence, such as photos, videos, and testimonies by witnesses and experts.
“The deadline to file the petition would be Wednesday at 23:59 WIB. The preparation for the petition has reached 97 percent. Evidence such as photos, videos, and testimonies by witnesses and experts have been collected. We are awaiting direction by the campaign time to start the filing process and finalizing other matters,” he said after the consultation.
On Sunday, December 8, the DKI Jakarta KPU (General Elections Commission) had certified the results of the 2024 DKI Jakarta election. Candidate pair 1 Ridwan Kamil-Suswono (RIDO) earned 1,718,160 or 39.4% of the votes. Candidate pair 2 Dharma Pongrekun-Kun Wardana earned 459,230 votes or 10.53%. Candidate pair 3 Pramono Anung-Rano Karno won the highest votes at 2,183,239 or 50.07% out of a total 4,714,393.
Deli Serdang Election Amid Disaster
Through legal counsel Nashril Haq Lubis, Deli Serdang regent-vice regent candidates 3 M. Ali Yusuf Siregar-Bayu Sumantri have filed a petition to the Court. The alleged that structured, systematic, and massive (TSM) violations had occurred, exacerbated by natural disaster, which further disrupted the regional election.
“On voting day, November 27, major floods hit almost all areas of Deli Serdang, causing only about 30 percent turnover of the total 1.4 million voters, or only about 400 thousand. The Deli Serdang KPU only conducted supplementary voting (PSS) and follow-up voting (PSL) at 31 polling stations, while the impact of the disaster was felt in all subdistricts,” Lubis said.
He explained that the impact of flooding was not only felt at a number of polling stations (TPS), but also in residential areas. “At that time, many residences were flooded, so the residents could not afford to think about turning up. However, the KPU only decided to organize supplementary voting (PSS) and follow-up voting (PSL) at 31 polling stations, which we think did not cover all of the impact[ed areas],” he said.
Lubis also highlighted that a more comprehensive policy by the KPU was necessary, in accordance with statutory regulations. In the petition to the Constitutional Court, his team included evidence in the form of photos, videos, and documents showing evidence of the impact of the disaster, including images of submerged houses.
“We hope the Constitutional Court will consider new arguments related to this force majeure. In addition, we also object to the implementation of the PSS and PSL, which did not cover all affected areas,” he said.
Lubis added that his team had previously submitted a similar request to the KPU, but it was not adequately followed up. He also requested that a revote (PSU) be conducted in almost all areas of Deli Serdang, because the floods hit from the night of November 26 until the next day.
The list of the 2024 regional election result dispute petitions on the Court’s website showed 166 petitions have been lodged thus far, with 133 on regent election and 33 on mayor election. Out of them, 90 were filed online through SIMPEL, while the other 76 were lodged on site.
