JAKARTA, MKRI - On Monday, December 9, 2024, parties continued to arrive at the Constitutional Court (MK). Late into the night, court case administration officers tirelessly served those who came in succession. Some parties visited the Constitutional Court to submit petitions for Regional Election Results Disputes (PHP Kada), while others sought consultations regarding the filing of PHP Kada petition.

Deployment of State Civil Apparatus

Candidate pair number 5, Ria Narulia Umlati and Benoni Saleo, through their legal representative, Kariadi, revealed fraud committed by candidate pair number 1 Orideko Burdam-Mansyur Sahdan. According to Kariadi, the incumbent vice regent engaged in unethical practices, including mobilizing State Civil Apparatus (ASN) and engaging in money politics.

“These are serious violations that we are bringing to light,” Kariadi stated. “The deployment of ASN and money politics fundamentally breach the principles of honest and fair democracy.”

Administrative and Criminal Violations

Bungo regent candidate pair number 1, Dedy Putra and Tri Wahyu Hidayat, have raised concerns regarding the vote acquisition of candidate pair number 2, Jumniwan Aguza and Maidani. Represented by their legal counsel, Kris Januardi, Dedy-Dayat questioned the legitimacy of the election results, pointing out that the winning candidate, a former Chairman of the Bungo DPRD, is the niece of the incumbent. Kris emphasized that their team has reported alleged violations by election organizers to the Bungo Election Supervisory Agency (Bawaslu).

 “We have observed and identified several indications of administrative and criminal violations,” said Kris. “Additionally, we discovered a viral video showing ballots being punctured with nails. We have taken initial action by reporting these issues to Bawaslu, but there has been no follow-up to date.”

Riots Lead to Loss of Lives

In the eastern part of Indonesia, Theodora Amfotis, Roslindawati, and Yohana Oematan have filed PHP petition in Dogiyai Regency, Central Papua. These petitions involve candidate pair number 4, Alfred Fredy Anouw and Orgenes Kotouki, as well as candidate pair number 6, Oskar Makai and Yani Bobi.

Theodora Amfotis highlighted several issues in the organization of the 2024 Dogiyai Regency elections. She pointed to riots that occured during the election, resulting in casualties. Theodora further revealed that one of the candidate pairs' success teams committed violations in the process of transporting ballot boxes from the district level to the regency, which led to changes in the vote tally during the Dogiyai Regency recapitulation. She mentioned thet, these issues had been reported, and recommendations had been made by the Dogiyai Election Supervisory Agency (Bawaslu). However, she claimed that the Dogiyai Election Commission (KPU) failed to implement these recommendations.

The list of the 2024 regional election result dispute petitions on the Court’s website showed 200 petitions have been lodged until Tuesday (10/12/2024) at 07.30 WIB, with 1 on governor election, 162 on regent election and 37 on mayor election. Out of them, 102 were filed online through SIMPEL, while the other 98 were lodged on site.
