JAKARTA (MKRI) — The Constitutional Court (MK) held another hearing for the 2024 election results dispute petitioned by the Indonesian Solidarity Party (PSI) on Tuesday, August 13, 2024 to hear the response by the General Elections Commission (KPU) as Respondent as well as the testimonies of the Relevant Party and the Elections Supervisory Body (Bawaslu) and to validate the litigants’ evidence. The second hearing for case No. 292-01-15-33/PHPU.DPR-DPRD-XXII/2024 was presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Asrul Sani on panel 2.
Stevanus Budiman conveyed the Respondent’s response that on June 28, the Jayapura Regency KPU had sent a letter to the Papua Provincial KPU to extend the repeat recapitulation of Sentani District. The Central KPU then issued a letter informing that the deadline for the repeat recapitulation would be July 4. This was because at the follow-up open plenary meeting for the repeat recapitulation of Sentani District on June 28, one of the C-result pages at three polling stations were not found: TPS 02 of Ifale Village, TPS 04 of Sentani Kota Village, and TPS 41 of Hinekombe Village.
“Therefore, in order to carry out the Jayapura Regency Bawaslu, the plenary meeting for the repeat recapitulation of Sentani District was on recess. So, the repeat recapitulation of Papua Province was completed on July 3, 2024 as per the provincial D-result model form from the repeat recapitulation,” explained Stevanus to the constitutional justices in the panel courtroom in the second building.
Correction Results
The Respondent refuted the Petitioner’s claim of the glaring discrepancy between the number of voters and voter turnout since the number of voters listed in the final voters list (DPT) who went to the polls after the repeat recapitulation was 44,875, or 11,801 more of that before the repeat recapitulation of the initial subdistrict D-result form being the revision or comparison between the C-result form and the initial D-result form. During the repeat recapitulation, the votes on the C-result form were 44,875, but 56,676 on the initial D-result form. Despite the purge of 11,801 votes, no objections were raised by party witnesses and the Jayapura Regency Bawaslu.
“The claim of the inflation of 2,734 voters in the DPK (special voters list) was due to correction by the Jayapura Regency KPU based on the real number on the C-result form. Therefore, the margin of 1,128 votes for legislative candidates and parties was due to correction by the Jayapura Regency KPU after comparison between the C-result form and the initial D-result form in Sentani District, which included 11,801 votes,” said Stevanus.
Indirect Supervision
Yofrey Priyamta N. Kebelen of the Papua Provincial Bawaslu reported that there was a note on witness objections during the repeat recapitulation during the reading of minutes for Sentani District, where the Jayapura Regency Bawaslu was absent. He said that on July 2, Bawaslu had supervise the repeat recapitulation of Sentani District. At 20:30 WIT, the Jayapura Regency Bawaslu had consulted and coordinated with the Papua Provincial Bawaslu on the deadline of the repeat recapitulation.
“When the Jayapura Regency Bawaslu went back to the plenary meeting room, the meeting had finished. When it consulted and coordinated with the Papua Provincial Bawaslu, indirect supervision was ongoing through YouTube livestream by the Jayapura Regency KPU,” Kebelen explained.

Following the Constitutional Court’s (MK) ruling on June 10, 2024, the Indonesian Solidarity Party (PSI) filed a petition challenging the 2024 election results dispute pertaining to the election of Papua Provincial Regional Legislative Council (DPRD) in Papua 3 electoral district. PSI requests the annulment of the KPU Decree No. 1050 of 2024 on the amendment to the KPU Decree No. 360 of 2024 on the nationwide certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced on Sunday, July 28, 2024 at 17:44 WIB.
At the preliminary hearing on Friday, August 9, legal counsels Francine Widjojo and Dede Gustiwan conveyed the petition’s subject matters. One of them is the votes for the 2024 Papua Provincial DPRD election in Sentani District in Papua 3 electoral district. The Petitioner alleges that the results were invalid and legally flawed because the repeat recapitulation in Sentani District had taken place past the deadline set by the Constitutional Court in Decisions No. 17-01-05-33/PHPU.DPR-DPRD-XXII/2024 and No. 202-01-08-33/PHPU.DPR-DPRD-XXII/2024 handed down on June 10, 2024.
Therefore, the Petitioner requests that the Court annul the KPU Decree No. 1050 of 2024 on the amendment to the KPU Decree No. 360 of 2024 on the nationwide certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) as it pertains to the results of the Papua Provincial DPRD election for Papua 3 electoral district, Jayapura Regency, Papua Province in Sentani District for passing the deadline set in the Constitutional Court Decisions No. 17-01-05-33/PHPU.DPR-DPRD-XXII/2024 and No. 202-01-08-33/PHPU.DPR-DPRD-XXII/2024 dated June 10, 2024.
