Witnesses Mention NasDem Votes Reduced in Papua 3

JAKARTA (MKRI) — The Constitutional Court continued the hearing for Case No. 17-01-05-33/PHPU.DPR-DPRD-XXII/2024 filed by the National Democratic Party (NasDem) regarding the General Election Results Dispute (PHPU). The session's agenda was to hear testimonies from witnesses/experts. NasDem argued that a shift in vote acquisition led to the loss of a seat in the Papuan People’s Representatives’ Council from the third electoral district

According to the Petitioner's witness, who also serves as the National Democratic Party (NasDem) district and regency level mandate holder, Eroolmoddy Marwery, discrepancies exist between the vote counts of several political parties in the Sentani District, comparing D. Form District/Regency Results and Copy of C. Form Results. He reported a reduction in NasDem's votes and an increase for other parties.
 

"Copies of C. Form and recaps from the KSN show differences in votes, with several parties, particularly NasDem, experiencing a decrease, whereas the Golkar Party gained about 3,000 votes. These changes were nearly uniform across all polling stations in Sentani," Erool stated before Panel 2 led by Deputy Chief Justice Saldi Isra, flanked by Constitutional Justices Ridwan Mansyur and Arsul Sani on Friday (5/31/2024).

Additionally, Petitioner's witness and Chairman of NasDem's National Witness Committee, Andreas Wakum, mentioned difficulties in obtaining vote recapitulation results at polling stations and district levels. He highlighted discrepancies in vote counts between the polling stations, District Election Committees (PPD), and regency levels.


"There is a difference from Papua 3, NasDem is short by 28 votes in Sentani District," said Andreas in the Hearing Room of Building 2 at the Court, Jakarta.

On the other hand, the Jayapura Regency General Elections Commission (KPU) confirmed that the Sentani District Elections Supervisory Committee (Panwaslu) was not provided with the District Results and Special Incident Forms by the Sentani PPD until the end of the plenary recapitulation meeting. Subsequently, Panwaslu Sentani issued a letter primarily urging the Sentani PPD to announce and provide the District Results to organizers and political party witnesses.

KPU Provincial Chair, Steve Dumbon, stated that during the plenary recapitulation at the Jayapura Regency level, there were objections from Bawaslu due to unsynchronized data. The plenary meeting was suspended for a considerable time for data synchronization. Once the data was synchronized, the plenary resumed and the recapitulation results were read. He asserted that there were no objections during the recapitulation process at the regency level. "The reading of the results went unopposed," said Steve.

The Constitutional Court has issued a Ruling Excerpt No. 17-01-05-33/PHPU.DPR-DPRD-XXII/2024 for this case. Prior to delivering the final decision, the Court declared the Petitioner's request regarding the election of members for the Jayapura City House of Representatives in Electoral District 4 as inadmissible.

In the petition, the Petitioner claimed there was an increase in votes for the Golkar Party by 3,120 votes in the Sentani District. Additionally, there were vote increases for other parties including the National Awakening Party (PKB) by 487 votes, while the National Democratic Party (NasDem) experienced a reduction of 28 votes. Due to these vote additions and reductions, NasDem secured only one seat. The Petitioner argues that if the original votes from the polling stations in the Sentani District were restored, NasDem would have obtained two seats, ranking first and ninth in the Papua Provincial Legislative Council for Electoral District 3.
