JAKARTA, MKRI - The Constitutional Court (MK) filed petition for case No. 202-01-08-33/PHPU.DPR-DPRD-XXII/2024 on the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute. The case was petitioned by the Prosperous Justice Party (PKS). was petitioned by the National Mandate Party (PAN) for the electoral district of west java province. The ruling hearing was held by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
Through Faudjan Muslim, the Petitioner stated that the Court should cancel KPU Decree No. 360 of 2024 concerning the Determination of the General Election Results of the President and Vice President, Members of the House of Representatives, Regional Representative Councils, (Province / Regency) Regional People's Representative Councils nationally announced on Wednesday, March 20, 2024 at 22:19 WIB.
Based on the comparison of PKS votes according to the Respondent is 6,658 and the Petitioner is 6,671, with a difference of 13 votes. According to the Petitioner, this occurred during the recapitulation at the Sentani sub district / district level on March 2, 2024. The Petitioner stated that it rejected the vote acquisition throughout Sentani District. Because, the petitioner felt disadvantaged due to the reduction of PKS votes and the addition of votes to 15 other parties. As a result, PKS lost the opportunity to obtain the 8th seat in the Papua Provincial DPRD. Therefore, the Petitioner requested the Court to determine the vote acquisition of PKS in Papua Dapil 3 by as many as 6,671 votes.
