JAKARTA (MKRI) — The National Democratic Party (NasDem) filed petition on the 2024 Legislative Election Results Dispute (PHPU) to Constitutional Court (MK) concerning the candidacy for members of the Papua Provincial House of Representatives (DPRP) in Electoral District (Dapil) 3 and the Jayapura Regency Legislative Council in Electoral District 4. The Petitioner alleges a shift in vote tallies that resulted in the loss of a seat in the DPRP for Electoral District Papua 3.
"At the regency-level plenary session, witnesses raised objections because they were not provided with copies of the District Form D Results during the subdistrict recapitulation, and the process only involved reading out the District D Results, which were not based on the Form C Results or C Plano. Witnesses noted their objections to revert to the results from the polling stations," stated Ucok Edison Marpaung, legal counsel for NasDem (Petitioner), in the Panel Hearing Room of Building 2 at the Constitutional Court, Central Jakarta on Thursday, May 2, 2024.
Ucok stated that there was an increase of 3,120 votes for the Party of Functional Groups (Golkar) in Sentani District. Additionally, there were vote increases for other parties as well, such as 487 or the National Awakening Party (PKB), while there was a reduction of 28 votes for NasDem. Due to these additions and reductions, NasDem only secured one seat. The Petitioner claims that if the original votes from the polling stations in Sentani District were restored, NasDem would secure two seats, ranking first and ninth in the Papua Provincial Legislative Council for Electoral District 3.
In their petitum, the Petitioner requests that the Court annul the General Elections Commission (KPU) Decision No. 360 of 2024 on the Certification of Election Results for Members of the House of Representatives (DPR), the Regional Representatives Council (DPD), Provincial Legislative Councils (DPRD Province), and Regency/City Legislative Councils (DPRD Regency) nationwide for the 2024 Election, announced on Wednesday, March 20, 2024, at 22:19 WIB, specifically regarding the vote tallies for DPRD Papua in Electoral District 3 and DPRD Jayapura Electoral District 4. The Petitioner also asks the Court to establish the correct vote tally according to the Petitioner for filling the membership of the DPRD Papua in Electoral District 3 as follows: NasDem with 19,246 votes.
Additionally, the Petitioner requests that the Court instruct the General Elections Commission (KPU) to carefully review the District D Results forms alongside the C Plano forms for DPRD Jayapura elections in Electoral District 4; conduct a tiered recapitulation of the election results for the DPRD Jayapura in Electoral District 4 in accordance with statutory regulations; and direct the Papua Provincial Elections Supervisory Body (Bawaslu) to oversee the aforementioned review.
The hearing for case No. 17-01-05-33/PHPU.DPR-DPRD-XXII/2024 was presided over by Deputy Chief Justice Saldi Isra, accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani.
