Ballots Already Marked in Wakasihu Village in Maluku

JAKARTA (MKRI) — The Constitutional Court held an evidentiary hearing of the election results dispute petitioned by Golkar (Party of Functional Groups) on Tuesday, May 28, 2024. The session was to hear witness/expert testimonies and examine and verify additional evidence.

At the hearing for Case No. 256-01-04-31/PHPU.DPR-DPRD-XXII/2024, the Court heard the witnesses’ testimonies: Aziz Mahulette, Haipan Tomagala, and Fatimah Sia for the Petitioner; Salmin Sanduan, Ahmad Rifai, and Abd. Gani Lumaela for the Respondent; and Saadiah Ruhunusa, Saiun Rosani Lumaela, and Salaman Tatisina for the Relevant Party.

Before Deputy Chief Justice Saldi Isra (chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani on Panel 2, Aziz Mahulette, a Golkar witness in Leihitu Subdistrict, said that initially, the C-copy form showed that Golkar received 21 votes at TPS (polling station) 02 of Kaitetu Village but only 20 on the D-result form. The C-copy form also showed that Golkar received 5 votes at TPS 07, but only 4 on the D-result form. Meanwhile, Golkar earned 13 votes at TPS 12 of Hitulama Village on the C-result form but only 17 on the D-result form.

“On the C-copy form for TPS 14 of Seith Village, Gelora earned 4 votes, but 5 votes on the C-result form. At TPS 20 of Hitumesing Village, Gelora had 34 votes on the C-copy and D-result forms. There, the [election supervisory committee] reported an incident where the final voters should only be 130 but the total votes were listed as 132. So, the votes were recalculated, and [it turned out that] one vote for Gelora was counted as two for both its candidate and the party, so corrections were made. When the subdistrict plenary meeting was held, Golkar received 2,319 votes and Gelora received 2,690 votes. At that time, as a witness, I challenged the PPK (subdistrict election committee) about the numbers that came out about 21 days after the counting. Since I believe that Gelora only received 2,663 votes, as a mandated witness I objected and did not sign the D-result forms up to the district level,” Aziz said.

Golkar’s regency witness Haipan Tomagala said a special incident had occurred at TPS 10 of Wakasihu Village in West Leihitu Subdistrict, which turned into a debate between witnesses and organizers. “Fifty remaining ballots were marked and cast for Gelora,” Haipan said.

Unused Ballots

Through Stevin Melay, Bawaslu explained that based on Bawaslu’s supervision report, there was an incident at TPS 10 of Wakasihu Village of a shortage of 51 ballots for the regency DPRD election. The election mechanism dictates that the KPPS (polling station working committee) communicated to get additional ballots and requested them from TPS 09 in the same village.

“The fact is that the ballots have been cast at TPS 9. We were not explained [they were cast] for which party. Because they have been cast, we did not distribute them to voters and categorized them as unused ballots, so they were not used for voting,” explained Stevin.

Recount by Panwascam’s Recommendation

Leihitu PPK chairperson Abd. Gani Lumaela explained that at TPS 12 of Kaitetu Village, Golkar’s 21 votes were reduced to 20 votes because a recount was done in the village based on the panwascam’s recommendation. At TPS 02 of Kaitetu, Golkar had 20 votes, but after a recount it became 19 votes. For TPS 08 of Seith Village, Golkar’s votes were also problematic so a recount was conducted.

“No recount was done at TPS 7 of Hila Village and TPS 14 of Ureng Village because there were no problems, while at 8 polling station, a recount was done, witnessed by all political parties and panwascam, and all signed [the election results document]. The recount was more about matching the numbers on the subdistrict D-result form,” explained Gani.

At the preliminary hearing on Tuesday, April 30, the Petitioner requested that the Court annul the General Election Commission Decree No. 360 of 2024 for the DPR election in the electoral district of Maluku 2 and the DPRD election in Central Maluku 4. The Respondent certified 11,278 votes for Golkar and 11,292 votes for NasDem in the DPR election in Maluku 2, leading to a difference of 17 votes. Next, for the Maluku Regency DPRD election in Central Maluku 4, Golkar Party received 3,207 votes according to the Respondent and 3,211 according to the Petitioner, so there was a difference of 4 votes. Meanwhile, Gelora’s (Indonesian People’s Wave Party) votes according to the Respondent were 3,271 and according to the Petitioner 3,193, so there was a difference of 78 votes.

The Petitioner mentioned that at TPS 12 of Hitu Lama Village, Leihitu Subdistrict, Central Maluku Regency, based on the C-result copy result owned by Golkar, there was an increase in votes for Gelora from 33 votes to 53 votes. In addition, at this polling station, there was also a shift in votes for the Indonesian Solidarity Party (PSI) from 15 votes to 0 votes.

Based on the explanation, the Petitioner requested that the Court order the Respondent to conduct a revote at TPS 03 of Seith Village, Teluk Kaeily Subdistrict, Maluku Province to fill the Maluku Provincial DPRD in Maluku 2. In addition, it requested that the Court determine the results of the recount of the votes of political parties and candidates for the Central Maluku Regency DPRD in Central Maluku 4, which were Golkar obtained 3,211 votes and Gelora obtained 3,193 votes. The Petitioner also requested that the Court order the Central Maluku Regency KPU to conduct a recount at TPS 10 of Wakasihu Village, Leihitu Subdistrict, Central Maluku Regency.
