Golkar Election Dispute Petition for Maluku 2 Inadmissible

JAKARTA (MKRI) — The Constitutional Court (MK) declared the petition of the Party of Functional Groups (Golkar) on the Regional Representative Council (DPRD) of Maluku Province of electoral district Maluku 2, as inadmissible. It is in accordance with an excerpt from Decision No. 256-01-04-31/PHPU.DPR-DPRD-XXII/2024 read by Constitutional Chief Justice Suhartoyo during the Ruling Hearing on the 2024 Election Results Dispute (PHPU) for Members of DPR (House of Representatives) and DPRD on Tuesday (5/21/2024).

In its legal considerations, delivered by Constitutional Deputy Chief Justice Saldi Isra, the Court highlighted that the PHPU petition for the DPRD of Maluku Province, electoral district Maluku 2, failed to meet formal requirements. As a result, the Petitioner's petition was deemed obscure and did not proceed to the evidentiary hearing.

"Meanwhile, regarding the Petitioner's petition on the DPRD of Central Maluku Regency, electoral district Central Maluku 4, it will be continued in the evidentiary hearing session," said Deputy Chief Justice Saldi from the Plenary Courtroom.

In the previous hearing, the Petitioner compared the vote acquisition for the members of the DPRD of Maluku Province, electoral district Maluku 2. According to the Respondent, Golkar acquired 11,278 votes, while NasDem acquired 11,292 votes, resulting in a margin of 17 votes. Furthermore, in electoral district Central Maluku 4, for the filling of members of the DPRD of Maluku Regency, Golkar, according to the Respondent, acquired 3,207 votes, whereas according to the Petitioner, it was 3,211 votes, resulting in a margin of 4 votes. Meanwhile, the vote acquisition for the Indonesian People's Wave Party (Gelora) was reported as 3,271 by the Respondent and 3,193 by the Petitioner, resulting in a margin of 78 votes.

Based on the provided information, the Petitioner requested that the Court to stipulate the correct results (recount) of the vote acquisition for political parties and candidates for member in the DPRD of Maluku Regency, electoral district Central Maluku 4, as follows: Golkar acquired 3,211 votes and Gelora acquired 3,193 votes. Subsequently, the Petitioner directed the Middle Maluku General Election Commission (KPU) to conduct a recount at Polling Station (TPS) 10 in Wakasihu Village, Leihitu District, Middle Maluku Regency.
