JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition on the Lanny Jaya regent election results dispute filed by Candidate Pair 01 Yemis Kogoya and Tanus Kogoya. Decision for Case No. 285/PHPU.BUP-XXIII/2025 was delivered at the ruling hearing held on Wednesday, February 5, 2025.
“On the petition’s subject matter, [the Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices on Wednesday, February 5, 2025.
Constitutional Justice Arief Hidayat, in the Court's considerations, stated that the Petitioners’ petition was unclear or vague. The Petitioners mentioned their vote acquisition in six districts, asserting that without reductions, the correct acquisition would be 80,700 votes for the Petitioners, 74,093 votes for Candidate Pair 02, and 32,305 votes for Candidate Pair 03. However, on page 35 of the posita, a table detailing the vote acquisition for each candidate pair showed different figures: 78,874 votes for the Petitioners, 75,083 votes for Candidate Pair 02, and 29,072 votes for Candidate Pair 03.
"Therefore, regarding the Petitioners’ argument, the Court cannot determine the exact number of votes obtained by each candidate pair or the valid votes claimed by the Petitioners. Therefore, based on the above explanations, the Petitioners’ posita is unclear," said Justice Arief.
Furthermore, the Court found inconsistent legal facts between petitum 2 and petitum 3. In petitum 2, the Petitioners requested the annulment of all votes in the 2024 Lanny Jaya regent election, thereby questioning the validity of the entire vote count. However, in petitum 3, the Petitioners instead requested the restoration of votes in six districts within Lanny Jaya Regency.
"Therefore, the formulation of the petitum results in inconsistency, rendering the Petitioners’ petition unclear or vague," said Justice Arief.

At the preliminary examination hearing, Candidate Pair 01 Yemis Kogoya–Tanus Kogoya (the Petitioners) filed a petition for Case No. 285/PHPU.BUP-XXIII/2025 concerning the Lanny Jaya Regency election results dispute to the Court. The Petitioners stated the significant decrease of votes in six districts on regency-level recapitulation.
The Petitioners further explained that their votes reduced 321 votes in Mokoni District. Based on C-Results Form from ten polling stations and D-Results Form at the district level, they obtained 2,517 votes. However, during the recapitulation at the regency level, it was reduced to 2,196 votes. A similar case also occurred in Gowa Balim District, based on C-Results Form from ten polling stations, the Petitioners should have obtained 1,568 votes, but they gained 714 votes after the regency-level recapitulation, a reduction of 854 votes.(*)
