JAKARTA (MKRI) — Regent Candidate Pair 3 Octopianus P. Tebai and Angkian Goo (Petitioners) petitioned the annulment of the Dogiyai KPU (Elections Commission) Decree No. 701 of 2024 to the Constitutional Court (MK). The preliminary hearing for Case No. 194/PHPU.BUP-XXIII/2025 was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1 on Thursday, January 16, 2025.
Denny Alan Pakiding as the Petitioners’ legal counsel delivered allegations of election violation in five districts: Mapia, Central Mapia, West Mapia, Piyaiye, and South Sukikai. He argued that there had been a shift of votes or support to Candidate Pair 2 Yudas Tebai-Yuliten Anauw from the great elder of Mee tribe, Simapitowa/Tota Mapiha group, whose authority encompasses the five districts.
“[There was] a transfer of votes from the great elder of Mee tribe, Simapitowa/Tota Mapiha group for the Petitioners to the Relevant Party. The shift was committed by the polling committee (PPS) at the district level in five districts. There was a collective agreement in Bomomani Village, Mapia District made on November 22, 2024 to support three candidate pairs of Mapia Besar tribe lineage: Candidate Pair 1 Rugen Magai-Mateus Douw, Candidate Pair 3 Otopianus P. Tebai-Angkian Goo, and Candidate Pair 6 Oskar Makai-Yani Bobi,” Pakiding said.
The collective agreement was made by the tribe elder whose authority covers five districts that had 31,115 votes, which were intended to be directed to Candidate Pairs 1, 3, or 6. The agreement stated that among the three, the pair acquiring the most votes in the valley region of Kamu, South Kamu, East Kamu, North Kamu, and Dogiyai Districts would be promised votes from Simapitowa group. In the end, Candidate Pair 3 obtained 7,174 votes—the highest compared to Candidate Pair 1 with 4,398 and Candidate Pair 6 with 5,695 votes—and should earn the 31,115 votes from Simatipowa. However, the KPU (Respondent) ignored the agreement and shifted the votes to Candidate Pair 2.
On the basis of the arguments above, the Petitioners requested that the Court declare the vote acquisition of the candidate pairs in the Dogiyai KPU decree on the election results according to the Petitioners as follows: Candidate Pair 1 Ruben Magai–Mateus Douw obtained 4,398 votes, Candidate Pair 2 Yudas Tebai–Yuliten Anauw received 28,717 votes, Candidate Pair 3 Otopianus P. Tebai–Angkian Goo (Petitioners) secured 38,289 votes, Candidate Pair 4 Alfred Fredy Anouw–Orgenes Kotoki garnered 16,952 votes, Candidate Pair 5 Freny Anouw–Abni Auwe secured 2,029 votes, and Candidate Pair 6 Oskar Makai–Yani Bobi obtained 5,695 votes, with at total of 96,080 valid votes.
