JAKARTA (MKRI) - Dogiyai regent-vice regent candidates 06 Oskar Makai and Yani Bobi filed the petition for the annulment of the Dogiyai Election Commission (KPU) Decree No. 701 of 2024 on the certification of the 2024 Dogiyai regent election results to the Constitutional Court (MK). The preliminary examination hearing on the regent election results dispute was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1 on Thursday, January 16, 2025.
In the petition for Case No. 175/PHPU.BUP-XXIII/2025, legal counsel Ferdinandus Eduardus Tahu presented the vote acquisition of the candidate pairs according to the Respondent as follows: Candidate Pair 01 Ruben Magai–Mateus Douw obtained 7,944 votes, Candidate Pair 02 Yudas Tebai–Yuliten Anauw received 41,900 votes, Candidate Pair 03 Otopianus P. Tebai–Angkian Goo secured 9,618 votes, Candidate Pair 04 Alfred Fredy Anouw–Orgenes Kotoki garnered 23,407 votes, Candidate Pair 05 Freny Anouw–Abni Auwe secured 2,292 votes, and Candidate Pair 06 Oskar Makai–Yani Bobi (Petitioners) obtained 10,919 votes, with a total of 98,080 valid votes. However, the Petitioners argued that the actual votes were different, with Candidate Pair 02 Yudas Tebai–Yuliten Anauw receiving 21,900 votes and the Petitioners obtaining 30,919 votes.
“According to the Petitioners, the difference in votes in the election occurred because there was an error in the vote counting at the district election committee (PPK). The organizer counted the noken* votes initially belonging to Petitioners but transferred them to Candidate Pair 02 in Yametadi Village, Kamu Utara District. This happened because of intimidation carried out by the Candidate Pair 02 campaign team to the Yametadi polling committee (PPS), Kamu Utara District, so that the PPS (polling committee) transferred the noken votes from the Petitioners to Candidate Pair 02,” said Ferdinandus in the plenary courtroom.
The Petitioners also reported that on November 28, 2024, the Candidate Pair 02 campaign team had committed a crime by stabbing the PPS chairman, who was requested to transfer the noken votes from Yametadi Village to Candidate Pair 02.
Due to the alleged violation, the Petitioners requested that the Court order the Dogiyai KPU to conduct a recount at the Kamu Utara PPK relating to the noken votes in Yametadi Village, specifically to return the Petitioners’ votes transferred to Candidate Pair 02. Additionally, they requested that the Dogiyai Bawaslu (Elections Supervisory Body) oversee the implementation of the recount at the Kamu Utara PPK relating to the Yametadi Village noken vote, with particular attention to overseeing the return of the Petitioners’ votes.

*The noken voting system is carried out by communities in Papua, either through public agreement on vote allocation or through the delegation of votes to a tribal leader.
