JAKARTA (MKRI) — The Constitutional Court Ethics Council (Majelis Kehormatan Mahkamah Konstitusi or MKMK) symbolically submitting a report to the Constitutional Court (MK) on Thursday (2/1/2024). MKMK has been working for one year, from 8 January to 31 December 2024 with the authority stated in Article 3 of PMK 1/2023.

On this occasion, Chief Justice of the Constitutional Court Suhartoyo received a report submitted directly by the MKMK Chairman I Dewa Gede Palguna accompanied by two of its members, Ridwan Mansyur and Yuliandri, in the Justice's Office on the 11th Floor. "This report should have been submitted on December 31, 2024 according to the end of the Constitutional Court's term of office, but the Constitutional Court is currently busy with hearings. Therefore, we have just officially submitted the report and may it be accepted," said Palguna.

Extension of MKMK's Term of Duty

Members of the 2024 MKMK re-swore an oath for the 2025 term of office. In overseeing and supervising the code of ethics of the constitutional justices, the Constitutional Court has again determined the extension of the MKMK's term of office based on the Decree of the Chief Justice of the Constitutional Court Number 6 of 2024 which was signed on December 12, 2024. Based on this decision, the three members have returned to carrying out their duties since taking the oath before the Chief Justice of the Constitutional Court, namely from January 2 to December 31, 2025.

The swearing-in of all three members was carried out in front of the Chief Justice of the Constitutional Court Suhartoyo in the Ground Floor Hall of Building 2 of the Court which was also attended by the Constitutional Justices and managerial officials of the Court. In his remarks during the ceremony, the Chief Justice said that after long discussion, the members of the 2024 MKMK were again given the trust to carry out their duties. "This decision was taken because the supervision carried out by the MKMK during its term of office was quite optimal. Therefore, the MKMK is asked to be willing to extend their duty. Congratulations on your new term of office and on the supervision that has been carried out previously and it is hoped that it will be more optimal and better in 2025," said Suhartoyo.

Maintaining and Upholding Honor

In a press conference after the ceremony, I Dewa Gede Palguna as the Chairman of MKMK together with its members conveyed several statements regarding their new term of office. "Before taking the oath, we had a meeting and stated that the structure of MKMK remains the same as in 2024 and there are no changes. The MKMK term of office for this period is from January 2 to December 31, 2025," said Palguna.

Palguna revealed that in submitting the report, MKMK reported two major things that had been done, efforts to maintain the integrity of the Constitutional Court and monitoring the code of ethics for constitutional justices. For this, MKMK has held 25 MKMK hearings. Then, there were 11 complaints of alleged violations of the code of ethics by constitutional justices with details of 3 complaints declared ineligible for registration and 8 complaints registered. All of the registered complaints have been decided periodically by MKMK.

Welcoming the 2025 term of office, Palguna said that he would be more proactive in preventing violations by constitutional justices. Palguna admitted that this step was actually unpopular in society, but for the MKMK by minimizing violations, it means that th task has been successful in guarding the Constitutional Court. "The main step taken by the MKMK is to prevent violations, because the fewer violations, the more successful our work will be. As the wise words say, let the report (alleged violations) be the last step in efforts to guard the Constitutional Court and its justices," explained Palguna.

Ethics Council for 2024 Term Takes Oath 

For your information, the establishment of the MKMK is a mandate of Article 27A paragraph (2) of the Constitutional Court Law which states, "To enforce the Code of Ethics and Guidelines for the Conduct of Constitutional Justices as referred to in paragraph (1), the Constitutional Court Ethics Council is formed...". Following up on this provision, on February 3, 2023, the Constitutional Court has stipulated Constitutional Court Regulation Number 1 of 2023 concerning the Constitutional Court Ethics Council. The provisions in question have been updated by Constitutional Court Regulation Number 11 of 2024 concerning the Constitutional Court Ethics Council (PMK 11/2024). Based on PMK 11/2024, the MKMK has the authority to maintain the dignity and honor of the Court. In addition, the MKMK has the authority to monitor the implementation of the Code of Ethics and Conduct of Constitutional Justices. Finally, the MKMK can examine and decide on alleged violations of the Code of Ethics and Conduct of Constitutional Justices.
