JAKARTA (MKRI) — The Constitutional Court (MK) rejected the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute petition for case No. 48-02-14-37/PHPU.DPR-DPRD-XXII/2024 on Monday, June 10, 2024. The case was petitioned by Emus M. Gwijangge, a DPRD candidate for the electoral district of Papua Pegunungan 1 from the Democratic Party. The hearing was presided over by Chief Justice Suhartoyo alongside the other eight constitutional justices.
In its legal considerations read out by Constitutional Justice M. Guntur Hamzah, the Court found that the evidence submitted by the Petitioner consisted of a photo of the photocopy of the DPRPP C-result copies, not the original forms as required by PKPU (General Elections Commission Regulation) No. 25 of 2023. Additionally, many forms only included the polling station working committee’s (KPPS) names without signatures or vice versa.
Additionally, he noted that some votes claimed by the Petitioner were listed under the Petitioner’s name column instead of the valid votes column, which the Petitioner then argued were his valid votes. The Court could not verify the authenticity and validity of the submitted evidence due to these discrepancies.
The Court also could not be convinced of the recapitulation at the provincial-level since there were no written objections. The Petitioner’s witness’ objection was not documented on the D-special incident and/or the KPU-witness objection form at the provincial level, which were not signed by the chair of the Papua Pegunungan Provincial KPU. After reviewing the Respondent’s evidence, the Court found that there were no objections recorded during the provincial recapitulation, as evidenced by the documents showing “null”.
Based on the aforementioned legal considerations, the Court concluded that the Petitioner’s claims were legally unfounded in its entirety.

In the case, Emus M. Gwijangge, a candidate for the Papua Pegunungan Provincial DPRD (Regional Legislative Council) from the Democratic Party, alleged that votes for candidate Fransina Daby were inflated. This dispute within the Democratic Party was addressed under case No. 48-02-14-37/PHPU.DPR-DPRD-XXII/2024.
