Democrat Candidates Fight for DPRD Votes in Papua Pegunungan Province 1

JAKARTA (MKRI) — The Democratic Party’s legislative candidate Emus M Gwijangge filed a petition on 2024 election results dispute (PHPU) to the Constitutional Court (MK) for the filling of candidates for Papua Pegunungan Electoral District (Dapil) 1 of Papua Pegunungan Province DRPD (Regional Legislative Council). Emus disputes the legislative’s seat with another candidate in Democratic Party, namely Fransina Daby.

The Petitioner said that there was a reduction in his votes from 12,707 votes based on the recapitulation of the Jayawijaya Regency KPU (General Elections Commission) level to 10,524 votes at the recapitulation level of the Papua Pegunungan Province KPU. Meanwhile, there was an addition of 2,183 votes during the plenary recapitulation of the vote count at the Papua Pegunungan Province KPU level to Fransina Daby. The reduction and addition of his votes occurred in Wamena District TPS (polling stations) 018 and 033.

"The vote count recapitulation process carried out by the Respondent (KPU) at the Jayawijaya Regency level is strongly suspected that there are differences in the recapitulation results at the Papua Pegunungan Province level," said Andhika in the Plenary Session Room of Building 1 of the Court, on Friday, May 3, 2024. Case No. 48-02-14-37/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah in Panel 1.

He said that he had submitted a record of special events and/or objections to witnesses to the recapitulation of the vote count results of the 2024 general election model D Provincial DPRD of Papua Province Pegunungan. According to him, the KPU and Bawaslu (Elections Supervisory Body) allowed administrative errors in the implementation of legislative elections by violating laws and regulations and violating the principle of luberjurdil (direct, public, free, confidential, honest, fair), so that the implementation of elections in Papua Pegunungan Province 1 lost legal legitimacy.

On his petitum, he requests the Court to cancel the KPU Decree Number 360 of 2024 on electoral districts which are: a. Papua Pegunungan Jayawijaya Province 1 for the filling of DPRD member candidates of Papua Pegunungan Province; b. Polling stations (TPS) 18, 33, C-results of Wamena Kota Village and C-results of TPS 14 Sinakma Village, Wamena District, Jayawijaya Regency, Papua Pegunungan Province; c. TPS 1 and 2 Dewene Village, TPS 01 Kaulangga Village, TPS 03 Maner Village, TPS 04 Manda Village, TPS 06 Manda Village, TPS 01 Tagulik Village, TPS 01 Totni Village, Bugi District, Jayawijaya Regency, Papua Pegunungan Province; d. Bpiri District, Jayawijaya Regency, Papua Pegunungan Province; and e. Bpiri District, Jayawijaya Regency, Papua Pegunungan Province; and e. TPS 02 and 03 Ayobaibur Village, TPS 01 and 02 Habema Village, TPS 03 and 05 holaliba Village, TPS 01 and 03 Ibele Village, TPS 01 and 02 Yagarobak Village, TPS 001, 002, and 003 Yelebarek Village, TPS 001, 002, 003, 004, 005, and 006 Yokalpalek Village, TPS 001, 002, 003, and 004 Zinai Village, and TPS 001 Zapma Village, Ibele District, Jayawijaya Regency, Papua Pegunungan Province.

He also requests to the Court to determine the correct vote acquisition results for the filling of member candidates of Papua Pegunungan Provincial DPRD throughout election district 1 from the Democratic Party to be Emus M Gwijangge S.T with 11,715 votes and Fransina Daby with 10,428 votes.(*)
