JAKARTA (MKRI) — The Constitutional Court held a follow-up hearing on Wednesday May 30, 2024 to examine dispute over the results of the 2024 DPR (House of Representatives) and Provincial and Regency/City DPRD (Regional Legislative Council) petitioned by the National Democratic Party (NasDem). The agenda of the hearing included listening to witness/expert testimonies as well as examining and validating additional evidence.
For case No. 65-01-05-13/PHPU.DPR-DPRD-XXII/2024, the Petitioner presented expert Kurnia Saleh and witnesses Khairul Ahmadi, Farizan Azmi, Bagas Baskara, Ahmad Majidun, and Pata Hindra Aryanto. Meanwhile, the Respondent presented Samsul Huda, Yustinus Arya A., Wakhid Thoyib, Isyadi, and M. Machruz as witnesses.
Khairul Ahmadi, a NasDem witness from Sukoharjo Regency, testified before Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on Panel 2. He said the party’s DPD (regional representatives council) chair told him not to sign the regency-level recapitulation due to vote shift. He admitted that in 12 subdistricts in Sukoharjo, no NasDem or Democratic Party witnesses signed the vote count due to suspected vote loss.
Farizan Azmi, a witness from Boyolali and a plenary meeting witness at the regency level, stated that he did not sign the DPR recapitulation for 22 subdistricts in Boyolali.
“We didn’t have C-copy forms because we lacked witnesses at the polling stations due to lack of funds, so we couldn’t protest or object and had to accept the Boyolali central executive board (DPP) chair’s instructions,” he explained.
Bagas Baskara, a NasDem witness for the plenary meeting covering 26 subdistricts in Klaten Regency, admitted to signing the minutes. “During the regency plenary meeting, we only had an incomplete D.Result form from the subdistricts, so there was no reason not to sign,” he stated.
Pata Hindra Aryanto, a volunteer for NasDem DPR candidates, stated that no witnesses signed the C-copy forms in Surakarta Regency, which consists of five subdistricts. “After the Provincial KPU plenary meeting, we gathered the C-copy forms from volunteers and citizens and then collected them from all over Central Java V,” he said.
Ahmad Majidun, a NasDem witness at the provincial level, admitted to not signing the plenary meeting resolution. “However, some of the four mandated witnesses did sign at the provincial level,” he mentioned.
Ballot Box Inspection
Samsul Huda from the Klaten Regency KPU denied the alleged shift of 2,046 votes across 150 polling stations in 21 out of 26 subdistricts. He stated that during the February 28-29, 2024 recapitulation, NasDem witness Bagas signed the minutes without objections. Bawaslu (Elections Supervisory Body) attended the plenary session and did not report any findings or recommendations.
Regarding the alleged vote transfer, Klaten KPU reviewed the C.result and D.result forms on April 28 and found no discrepancies as claimed by the Petitioner. The KPU inspected the ballot boxes on April 26 based on a letter dated April 25 in the presence of all political parties and Bawaslu.
“Discrepancies were found at three polling stations. TPS 9 in Wonoboyo Village had a 1 vote discrepancy for a NasDem candidate, which was corrected at the subdistrict level and documented on a D-incident form. Similarly, TPS 6 in Glagahwangi Village had a 1 vote discrepancy for a Gerindra candidate, which was also corrected. Lastly, TPS 29 in Karanganom Village had a 5 vote discrepancy for PSI, not NasDem,” he explained.

At the preliminary hearing on Monday, May 30, the Petitioner noted discrepancies in vote counts benefiting other political parties in the electoral district of Central Java V, including Klaten, Boyolali, Sukoharjo, and Surakarta, totaling 11,539 votes. This vote transfer resulted in the loss of a DPR seat for Central Java V. They claimed the correct vote count was 132,229, while the Respondent stated NasDem’s count was 123,690. The transfer allegedly favored Gerindra (Great Movement Party), PSI (Indonesian Solidarity Party), Perindo (United Indonesia Party), Garuda (Indonesian Guard of Change Party), and PDI-P (Indonesian Democratic Party of Struggle). They requested the Court annul and the minutes of the vote recapitulation No. 218/PL.01.08-BA/05/2024 of the 2024 general election dated March 20, 2024.
