JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing on the 2024 election results dispute of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) on Tuesday (7/5/2024). The second Hearing of Case No. 65-01-05-13/PHPU.DPR-DPRD-XXII/2024 filed by the NasDem Party was presided over by panel 2—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
In the hearing agenda of the Respondent's answers and statements from Relevant Parties and Bawaslu, Asep Andryanto acted as the Respondent's legal counsel. He said the Petitioner received 132,890 votes and NasDem received 123,690 votes, so there was a margin of 9,200 votes. Meanwhile, the limit for DPR seats for the Central Java V is 8 seats covering the areas of Klaten Regency, Surakarta City, Boyolali Regency, and Sukoharjo Regency.
"However, the Petitioner did not explain and elaborate on the request for the vote in the petition which would affect the acquisition of DPR seats for the Central Java V as a result of the 2024 Election. Thus, the Petitioner's petition must be rejected," said Asep.
Migration Votes
M. Zainuddin in the statement from the PKB (Relevant Party) stated the margin in the Petitioner's vote acquisition in four places (locus) as follows; Klaten, Boyolali, Sukoharjo, and Surakarta, resulting in 11,539 votes. The Relevant Party explains that the statement is untrue. This is because the KPU has not yet determined the acquisition and allocation of seats for candidate of DPR members. Similar to the vote migration which the Petitioner considers beneficial to the Relevant Party, Zainuddin said that each stage of the vote had been carried out well and had no disputes because the witnesses and Bawaslu actively participated in the recapitulation.
"Regarding the votes margin, NasDem got 135,229 votes, after PKB compared the Petitioner's data and the KPPS form of C.Results and D.District Results, there was no suitable and correct Applicant data to support the arguments" said Zainuddin.
