No Party Consent, Gerindra Candidate’s Election Dispute Petition Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) declared the 2024 general election results dispute for case No. 86-02-02-12/PHPU.DPR-DPRD-XXII/2024 inadmissible because the case filed by the Great Movement Party (Gerindra) legislative candidate Mustofa was not supported by an approval letter from the party.

“[The Court] adjudicated, relating to the exception: first, to reject the Respondent’s exception on the Court’s authority; second, to grant the Respondent’s exception on the Petitioner’s legal standing; relating to the petition: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo at a ruling hearing in the plenary courtroom, Jakarta on Tuesday, May 21, 2024.

Constitutional Justice M. Guntur Hamzah explained that the requirements as specified in Article 8 paragraph (3) of the Constitutional Court Regulation No. 2 of 2023, the petition dated March 23, 2024 filed by the Petitioner did not include Gerindra’s approval. This was confirmed by the Petitioner at the preliminary hearing on April 30, 2024.

“Moreover, at the preliminary hearing, after [being asked] by the Court, the Petitioner confirmed that he did not obtain a written letter of approval from the party for him to file an individual election results dispute petition to the Court,” Justice Guntur said.

According to the Court, the Petitioner did not fulfill the formal requirements for the petition. Therefore, he did not have legal standing to file the petition. As such, the KPU’s (General Elections Commission) or Respondent’s exception regarding the Petitioner not having legal standing was reasonable according to the law.

The Petitioner, in his petition, questioned the difference of three votes in the race for the seat of Bekasi City DPRD (Regional Legislative Council) in electoral district (dapil) 1. He argued that there had been an increase in votes for another Gerindra candidate Yadi Hidayat, as many as 30 votes at polling station (TPS) 36 in South Bekasi Subdistrict and 19 votes at TPS 104 in Jaka Mulya Village. Meanwhile, he said that the Respondent determined his vote count to be 5,598 votes, which was three votes less than his version of 5,601 votes. The reduction of his votes occurred at TPS 60 of Jakasetia Village, South Bekasi Subdistrict by two votes and one vote at TPS 137 of Aren Jaya Village, East Bekasi Subdistrict.
