JAKARTA (MKRI) — Presidential and Vice Presidential Candidate Number 2 Prabowo Subianto and Gibran Rakabuming Raka have filed a request to be a Relevant Party for the presidential election results dispute (PHPilpres) cases. The Prabowo-Gibran Defense Team filed the request on Monday evening, March 25, 2024 in the Constitutional Court’s (MK) main building. The team arrived after two presidential election dispute petitions by the other two presidential tickets Anies-Muhaimin and Ganjar-Mahfud had been registered.
Spokesperson Yusril Ihza Mahendra said 45 advocates that have joined the defense team had submitted documents to meet the administrative requirements to be a Relevant Party, which were received by Chief Registrar Muhidin. He said that after this, the defense team would be preparing the responses to the petitioners’ arguments. These responses would have to be submitted by Wednesday, March 27, to then be conveyed verbally at the hearing for the presentation of the Relevant Party’s testimony on Thursday, March 28.
“The Defense Team has shared the same stance, is prepared, and is capable of responding to all arguments and rebutting the evidence by the Petitioners in the two petitions filed to the Court. The team has worked swiftly to face all the Petitioners’ arguments,” said Yusril, who arrived at the Court alongside well-known advocates such as Otto Hasibuan, O.C. Kaligis, and Hotman Paris Hutapea.

Formally and Procedurally Flawed
Otto Hasibuan added that the Prabowo-Gibran Defense Team believes that the petitions are formally and procedurally flawed and would potentially be rejected by the Court since the Petitioners are questioning the election process and election violations, which are under the jurisdiction of the Elections Supervisory Body (Bawaslu), the state administrative court (PTUN), and the Supreme Court (MA). The Constitutional Court, he stressed, has jurisdiction on the results of the election.
“What should be challenged to the Constitutional Court is the election results. This is firmly regulated in the Election Law and the Constitutional Court Regulation. It has been regulated that what should be requested in the subject matter must be the accurate and inaccurate votes count. So, the petitum should be about the annulment of the KPU decision on vote count [results],” Hasibuan explained.
Adding to Hasibuan’s statement, O.C. Kaligis stated that the Petitioners’ narratives cannot be used as evidence in Court. He stressed that the Prabowo-Gibran Defense Team is prepared to respond to all of the Petitioners’ arguments. The Echo (legal and advocacy) Team of the Prabowo-Gibran campaign team (TKN) was also present. The team, whose members include Habiburokhman, Fachmi Bachmid, and Francine Widjojo, is led by Hinca Pandjaitan.
Presidential and Vice Presidential Candidates Number 1 Anies Rasyid Baswedan-Muhaimin Iskandar (AMIN) have filed a presidential election results dispute petition to the Court on Thursday, March 21. The petition was registered by the Registrar’s Office on Sunday, March 25 as case No. 1/PHPU.PRES-XXII/2024. In the 112-page petition, AMIN argue that President Joko Widodo has committed a lot of violations and shown partiality in the 2024 election because his son Gibran Rakabuming Raka is running for vice president. They also argue that social assistance (bansos) for the people have been misused, thus boosting votes for Prabowo-Gibran.
Presidential and Vice Presidential Candidates Number 3 Ganjar Pranowo-Mahfud MD have also filed a presidential election results dispute petition to the Court. In the case No. 2/PHPU.PRES-XXII/2024, they allege that President Joko Widodo has committed nepotism. In their petitum, the presidential ticket request that Prabowo-Gibran be disqualified and that a revote with only Anies-Muhaimin and Ganjar-Mahfud on the ballot be held on June 26.
The General Elections Commission (KPU) has announced the results of the 2024 general election on Wednesday, March 20, 2024). The results are stipulated in the KPU Decree No. 360 of 2024 on the Stipulation of the 2024 General Election Results of the President and Vice President, Members of the House of Representatives (DPR), Regional Representatives Council (DPD), Provincial and Regency/City Legislative Councils (DPRD). The 2024 election results were finalized based on KPU minute No. 218/PL.01.08-BA/05/2024, which was announced immediately after the KPU completed the national recapitulation and plenary meeting on Wednesday evening, March 20. The KPU’s national recapitulation results encompassed votes from 38 provinces and 128 overseas elections committees (PPLN). The total number of valid national votes is 164,227,475. According to the KPU recapitulation results, Prabowo-Gibran secured victory with 96,214,691 of the total national valid votes. Meanwhile, Anies-Muhaimin garnered 40,971,906 votes, and Ganjar-Mahfud received 27,040,878 votes.
