JAKARTA (MKRI) — The Constitutional Court approved the withdrawal of the petition by Sigit Yulianto on the material judicial review of Article 30 paragraph (2) of Law No. 2 of 2002 on the National Police of the Republic of Indonesia. The ruling for Decree No. 229/PUU-XXIII/2025 was delivered by Chief Justice Suhartoyo, December 17, 2025.
It was affirmed that the Court had received the petition filed by Sigit Yulianto and also a letter requesting withdrawal of the petition, each with their respective reasons. Furthermore, the Court had asked for confirmation of the withdrawal of the petition in question at a hearing.
Subsequently, the justice deliberation meetings (RPH) on December 2, 9, and 10, 2025 determined that the withdrawal of the petition was legally justified and that the Petitioner may not refile the petition a quo. The constitutional justices further ordered the Registrar’s Office to record the withdrawal of the petitioner’s petition in the electronic constitutional case registration book (e-BRPK) and to return the copy of the petition to the Petitioner.
“The Court approves the withdrawal of the Petitioner’s petition,” said Chief Justice Suhartoyo delivering the decree for the petition a quo.

The Petitioner had previously sent a letter regarding the cancellation of the case to the Constitutional Court’s Registrar’s Office. The preliminary hearing for this petition, which confirmed the withdrawal of the petition, lasted a little under four minutes. In the case file accessible through the Court’s official website, the Petitioner had originally submitted a judicial review petition of the provision regulating the maximum retirement age of police officers at 58 years, and for officers possessing special expertise deemed essential for police duties, their service may be extended up to 60 years.
According to the Petitioner, the provision of Article 30 paragraph (2) of the Police Law is inconsistent with Article 27 paragraph (1) and Article 30 paragraphs (2) and (5) of the 1945 Constitution of the Republic of Indonesia. In the petition’s petitums, the Petitioner requested that Article 30 paragraph (2) of the Police Law be reinterpreted so that the retirement age of members of the Indonesian national police shall be 58 years for enlisted and non-commissioned personnel, 60 years for officers, and, specifically for functional officials in accordance with statutory regulations governing such positions, 65 years.
