Petitioner Cancels Petition on Police’s Retirement Age

JAKARTA (MKRI) — Sigit Yulianto, the Petitioner in case No. 229/PUU-XXIII/2025, withdrew his material judicial review petition of Article 30 paragraph (2) of Law No. 2 of 2002 on the State Police of the Republic of Indonesia. The withdrawal was confirmed at the panel preliminary hearing on Monday, December 1, 2025.

“Is it accurate that the Petitioner has submitted a letter withdrawing the petition?” asked Chief Justice Suhartoyo, who chaired the panel alongside Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.

The Petitioner, represented by legal counsel Jonathan Waeo Salisi, conveyed a letter regarding the cancellation of the case to the Constitutional Court’s Registrar’s Office. “That is correct, Your Honor. The Petitioner informed me and then sent a letter, but [I] have not yet received the original letter.  However, since he has already conveyed it, I am compelled to submit it to the Constitutional Court,” Salisi said.

Before adjourning the hearing, Chief Justice Suhartoyo stated that this would be reported to the justices’ deliberation meeting. Subsequently, the Court will issue a decree on the withdrawal of the petition, and the ruling hearing for the pronouncement of the said decree will be announced later. “If there is time, you are welcome to attend; attending via Zoom is also acceptable,” he said.

The preliminary hearing for this petition, which confirmed the withdrawal of the petition, lasted a little under four minutes. In the case file accessible through the Court’s official website, the Petitioner had originally submitted a judicial review petition of the provision regulating the maximum retirement age of police officers at 58 years, and for officers possessing special expertise deemed essential for police duties, their service may be extended up to 60 years.

According to the Petitioner, the provision of Article 30 paragraph (2) of the Police Law is inconsistent with Article 27 paragraph (1) and Article 30 paragraphs (2) and (5) of the 1945 Constitution of the Republic of Indonesia. In the petition’s petitums, the Petitioner requested that Article 30 paragraph (2) of the Police Law be reinterpreted so that the retirement age of members of the Indonesian national police shall be 58 years for enlisted and non-commissioned personnel, 60 years for officers, and, specifically for functional officials in accordance with statutory regulations governing such positions, 65 years.
