KPU Tasikmalaya Clarifies Verification Process for Regent Candidacy in Revote

JAKARTA, MKRI – Based on Constitutional Court Decision Number 132/PHPU.BUP-XXIII/2025, it is understood that the registration process applies solely to the replacement candidate, Ade Sugianto. Other candidate pairs are not required to undergo re-registration, as their candidacy and nomination requirements had already been verified and fulfilled in the previous stages.

Such information was conveyed by Khairil Amin, legal counsel for the Tasikmalaya Regency General Election Commission (KPU), during the continued hearing of Case Number 324/PHPU.BUP-XXIII/2025 concerning the 2024 Tasikmalaya Regent Election Results Dispute. The hearing, held on Tuesday (20/5/2025), addressed the petition filed by Candidate Pair Number 3, Ai Diantani Ade Sugianto and Iip Miptahul Paoz (Petitioner). The hearing was presided over  by Chief Justice Suhartoyo and accompanied by Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamza in the panelcourt 1.

Khairil further explained that the other two candidate pairs, namely Iwan Saputra–Dede Muksit Aly and Cecep Nurul Yakin–Asep Sopari Al Ayubi, were not required to re-register, as the Constitutional Court Decision Number 132/PHPU.BUP-XXIII/2025 did not mandate such an action. Therefore, according to the Respondent, those candidate pairs were only required to proceed to the next stage, which was the determination of the candidate pairs alongside the newly registered pair, Ai Diantani Ade Sugianto–Iip Miptahul Paoz.

“Thus, the argument that concludes only the Petitioner is valid because they registered, while other candidates are invalid because they did not re-register, is incorrect and misleading. The Petitioner re-registered with the KPU based on a direct order from the Constitutional Court, and that is precisely how it should be. This reasoning is comparable to a situation where a candidate passes away—the re-registration process would then only apply to the replacement candidate, not to all participants. This has also been explicitly confirmed by the Constitutional Court,” Khairil stated.

At the Preliminary Hearing held on Thursday (15/5/2025), the Petitioner requested the annulment of the Decision of the General Election Commission (KPU) of Tasikmalaya Regency Number 35 of 2025 concerning the Determination of the Recapitulation of Vote Counting Results for the 2024 Election of the Regent and Deputy Regent of Tasikmalaya Regency, dated April 19, 2025. The Petitioner argued that the implementation of the Re-voting stage in Tasikmalaya Regency was not carried out in accordance with General Election Commission Regulation Number 8 of 2024 in conjunction with General Election Commission Regulation Number 10 of 2024 regarding the stages and schedule for the Election of Governors and Deputy Governors, Regents and Deputy Regents, as well as Mayors and Deputy Mayors. Furthermore, the process was claimed to have disregarded the guidelines set forth in Constitutional Court Decision Number 132/PHPU.BUP-XXIII/2025.

It was asserted that the General Election Commission (KPU) of Tasikmalaya Regency (Respondent), in implementing the Re-voting (Pemungutan Suara Ulang/PSU), relied solely on the General Election Commission Letter Number 494/PL.06-SD/06/2025 dated March 4, 2025, without referring to General Election Commission Regulation Number 8 of 2024. The Respondent re-opened the registration process exclusively for Candidate Pair Number 3, without re-opening registration for all candidate pairs, despite the fact that the legal status of all candidate pairs had been annulled through Constitutional Court Decision Number 132/PHPU.BUP-XXIII/2025. Consequently, the Respondent's actions are deemed unlawful and constitute administrative misconduct in the form of actions that contravene legal provisions and ethical standards in the electoral administrative process.

Therefore, the Petitioner requests the Court to declare the disqualification of Regent and Vice Regent Candidate Pair Number 1, Iwan Saputra–Dede Muksit, and Candidate Pair Number 2, Cecep Nurul Yakin–Asep Sopari Al Ayubi; to declare null and void the Decision of the General Election Commission (KPU) of Tasikmalaya Regency Number 35 of 2025 concerning the Determination of the Results of the Re-Voting for the 2024 Election of Regent and Vice Regent of Tasikmalaya Regency following the Constitutional Court’s Decision on the Election Results Dispute, insofar as it concerns the vote acquisition of Candidate Pair Number 1, Iwan Saputra–Dede Muksit, and Candidate Pair Number 2, Cecep Nurul Yakin–Asep Sopari Al Ayubi; to declare null and void the Decision of the KPU of Tasikmalaya Regency Number 10 of 2025 concerning the Determination of Candidate Pairs for the 2024 Election of Regent and Vice Regent of Tasikmalaya Regency dated March 23, 2025, insofar as it pertains to Candidate Pair Number 1, Iwan Saputra–Dede Muksit, and Candidate Pair Number 2, Cecep Nurul Yakin–Asep Sopari Al Ayubi; to declare null and void the Decision of the KPU of Tasikmalaya Regency Number 11 of 2025 concerning the Determination of the Elected Candidate Pair for the 2024 Election of Regent and Vice Regent of Tasikmalaya Regency dated March 23, 2025, insofar as it pertains to Candidate Pair Number 1, Iwan Saputra–Dede Muksit, and Candidate Pair Number 2, Cecep Nurul Yakin–Asep Sopari Al Ayubi; and to determine Candidate Pair Number 3, Ai Diantani Ade Sugianto–Iip Miftahul Paoz, as the winner of the Re-Voting of the 2024 Election of Regent and Vice Regent of Tasikmalaya Regency, with a total of 269,075 valid votes.
