JAKARTA, (MKRI) - The General Election Results Dispute (PHPU) Hearing of the Regent and Deputy Regent of Tasikmalaya, West Java, revealed an issue related to the term of office of Ade Sugianto (Relevant Party). The Petition for PHPU of Tasikmalaya Regent, Case Number 132/PHPU.BUP-XXIII/2025 was filed by the Candidate Pair of Tasikmalaya Regent and Vice Regent Number 2, Cecep Nurul Yakin and Asep Sopari Al-Ayubi. 

The Petitioner's legal counsel, Usman, and Wiwin Wintarsih read out the main points of the petition in the Preliminary Hearing held by court panel 1 of the Constitutional Court (MK) on Wednesday, January 8, 2025. The hearing was presided over by the Chief Justice Suhartoyo accompanied by Constitutional Justices Daniel Yusmic P Foekh and M Guntur Hamzah.

In his petition, the Petitioner argued in detail regarding the term of office of the Relevant Party, in this case, the Candidate Pair of Regent and Deputy Regent of Tasikmalaya Number 3, Ade Sugianto and Iip Mipathul Paoz. According to the Petitioner, the term of office of the Relevant Party does not fulfill the requirements for the nomination of regents and deputy regents.

"That Candidate Pair number 3 does not fulfill the nomination requirements because they have served as Regent and Deputy Regent of Tasikmalaya for two terms of office," said the Petitioner's legal counsel, Usman, in front of the Panel.

Usman said the first is valid from 3 December 2018 to 26 April 2021 as the definitive Tasikmalaya Regent between the two terms of office. The Relevant Party served for 2 years, 7 months, and 18 days if accumulated. Then for the second term, the Petitioner argued that the Relevant Party had served as Regent of Tasikmalaya from 2021 to 2025.

Based on the arguments of this petition, the Petitioner filed a petition, requesting that the Court disqualify the Relevant Parties in the 2024 Tasikmalaya Regent and Deputy Regent Elections. In addition, the Petitioner also requested that the Court declare him the winner and order the Tasikmalaya Regional General Election Commission (KPUD) to conduct a re-vote.

"The Petitioner requests the Court to deliver the following decision: Ordering the Tasikmalaya Regency General Election Commission to conduct a re-voting in the 2024 Tasikmalaya Supati and Deputy Supati Election without including the Galon Pair Ade Sugianto and Lip Miptahul Paoz," said Wiwin as the Petitioner's Legal Counsel when reading out the petitum at the hearing.

At the Petitioner's petition, Constitutional Justice Suhartoyo ordered the General Election Commission (KPU) as the Relevant Party to later respond. The Election Supervisory Body (Bawaslu) and Relevant Parties were also asked to respond to the Petitioner's request. 

"Well, later, the General Elections Commission (KPU) will respond to this, the Relevant Parties must also provide their response, and Bawaslu must be able to explain this as well. This is important," said Chief Justice Suhartoyo.
