JAKARTA (MKRI) — 2024 Puncak Jaya regent-vice regent candidates Miren Kogoya and Mendi Wonerengga challenge the re-recapitulation of election results in case No. 311/PHPU.BUP-XXIII/2025, which was ordered by the Constitutional Court (MK) in Decision No. 305/PHPU.BUP-XXIII/2025. The candidates number 2 argue that there had been violations that significantly impacted the results.
At the preliminary hearing on Friday, April 25, 2025, legal counsel M. Imam Nasef revealed that the Respondent’s data show the re-recapitulation results as follows: candidate pair number 2 earned 77,296 votes while the Petitioners earned 65,787, with a margin of 11,509 between the two.
“We realized that we did not meet the provision of Article 158 (of the Election Law), but we hope that the enforcement of the provision can be disregarded or at least postponed, due to fundamental violations and special incidents,” Nasef said before Constitutional Justice Arief Hidayat and the members of the panel.
The Petitioners also argued that regent candidate number 1 Mus Kogoya did not meet the candidacy requirement since he was an active ASN (state civil apparatus) until January 2025.
“Mus Kogoya still received salary and benefits as ASN until January 2025. In addition, BKN’s (National Civil Service Agency) data shows that his dismissal led to no pension, effective on January 25, 2025. This is clearly in violation of the requirement since during registration, he has not resigned from civil service,” Nasef said.
He revealed that BKN had confirmed this fact. He requested that the Court present BKN at the hearing to verify it objectively.
In addition, the Petitioners revealed, the General Elections Commission (KPU) as Respondent had erroneously implemented Constitutional Court Decision No. 305/PHP.BUP-XXIII/2025. In its legal consideration, the Court expressed doubt over the recapitulation results of all districts in Puncak Jaya Regency, including four key districts: Mulia, Lumo, Tingginambut, and Gurage. It also expressed doubt over the results of the other 22 districts. However, in the re-recapitulation on March 12, 2025, the KPU did not re-recapitulate at the district level nor did they read out the C-result-KWK forms of all polling stations, all while claiming that they did not have those documents.
The Petitioners believe the re-recapitulation in three districts were in serious doubt: Ilu, Irimuli, and Molanikime. There is a significant gap between the results presented by the KPU and by the Petitioners for those districts, amounting to 7,210 votes. Nasef emphasized that in Ilu, Irimuli, and Molanikime, candidate pair number 1 vs. the Petitioners had the following number of votes: 8,411 vs. 5,064 votes; 5,329 vs. 2,564; and 3,200 vs. 931—respectively.
This brought the total valid votes to 143,083, according to the Petitioners, where candidate pair number 1 had 70,086 votes while the Petitioners won by 2,911 with 72,997 votes.
“In the previous regional election, we also doubt the results of all districts, especially in 22 districts for which the Court ordered [a re-recapitulation]. We hope this will be the Court’s consideration to suspend the enforcement of Article 158,” Nasef said.
In their petitums, the Petitioners request the Court to disqualify regent candidate number 1 Mus Kogoya from the 2024 Puncak Jaya regent election; to cancel the Puncak Jaya KPU Decree No. 375 of 2024 on the stipulation of the 2024 Puncak Jaya regent election candidate pairs relating to Mus Kogoya as a Puncak Jaya regent candidate; to cancel the Puncak Jaya KPU Decree No. 380 of 2024 on the stipulation of the order numbers of the 2024 Puncak Jaya regent election candidate pairs dated September 23, 2024 relating to Mus Kogoya as a Puncak Jaya regent candidate.

In Decision No. 305/PHPU.BUP-XXIII/2025, the Court ordered the KPU to re-recapitulate the 2024 Puncak Jaya regent election in 22 districts. The case was filed by Puncak Jaya regent candidate pair number 1 Yuni Wonda and Mus Kogoya. The re-recapitulation would not include Mulia, Lumo, Tingginambut, and Gurage Districts.
In its legal consideration, the Court held that recapitulation could not be done due to sabotage and seizure of election logistics in the four districts. It was alleged that regent candidate pair number 2 Miren Kogoya and Mendi Wonerengga had seized ballot boxes, ballot papers, and election reports in Mulia and Lumo Districts on November 26, 2024.
