Question Raised Over Alleged TSM Violations in Puncak Jaya Regent Election

JAKARTA (MKRI) – Puncak Jaya regent-vice regent Candidates 01 Yuni Wonda and Mus Kogoya have filed a petition disputing the Puncak Jaya regent election results to the Constitutional Court (MK). The Petitioners in Case No. 305/PHPU.BUP-XXIII/2025 alleged the occurrence of structured, systematic, and massive (TSM) violations that have significantly influenced the election results.

At the preliminary examination hearing on Wednesday, January 15, 2025, the Petitioners’ legal counsel Hardian Tuasamu revealed several alleged violations. Among these was the alleged control of election logistics by Candidate Pair 02 in four districts: Mulia, Tingginambut, Gurage, and Lumo.

“On November 26, 2024, logistics in the four districts should have been distributed. However, at around 16:00 WIT, the Puncak Jaya KPU office was visited by the Puncak Jaya regent-vice regent candidates along with their supporters and campaign team,” explained Tuasamu.

He further revealed that after the logistics had been collected in Puncak Jaya, no vote recapitulation occurred at the district level. Instead, it was relocated to Nabire due to security concerns. The decision was outlined in the Central Papua KPU (Elections Commission) Decree dated December 7, 2024, which subsequently received approval from the Central KPU on December 8, 2024.

“Regarding the forced seizure of logistics, on November 30 the Puncak Jaya Bawaslu issued several recommendations, which we also use as evidence,” he explained.

Tuasamu said the Puncak Jaya KPU had completed the vote recapitulation in around 15 districts and had followed up on the recommendation of the Puncak Jaya Bawaslu (Elections Supervisory Body) not to recap the votes in Mulia District and Lumo District. However, without any clear reason, the Central Papua KPU took over the duties of the Puncak Jaya KPU.

“In accordance with the applicable mechanism at the KPU, the takeover of duties by the province should be preceded by the temporary deactivation of the regency KPU. Until now, there has been no decree from the Central KPU deactivating the Puncak Jaya KPU commissioner,” he emphasized.

Therefore, in their petitums, the Petitioners requested the Court to grant their petition in its entirety. In addition, they requested that the Court annul the Puncak Jaya KPU Decree No. 476 of 2024 on the certification of the 2024 Puncak Jaya regent election results issued on December 18, 2024 at 06:32 WIT concerning the vote acquisition in Mulia District, Lumo District, Tingginambut District, Gurage District, Pagaleme District, Dokome District, Kalome District, and Ilamburawi District.
