Petition Filed by Robby-Hengky on Paniai Election Dismissed

JAKARTA (MKRI) – The Constitutional Court (MK) dismissed the petition filed by Candidate Pair 02 Robby Kayame and Hengky Kudiai. According to the Court, the petition for Case No. 291/PHPU.BUP-XXIII/2025 on the 2024 Paniai regent election results dispute was unclear or vague.

“On the petition’s subject matter, [the Court] declares the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing alongside the other eight constitutional justices on Wednesday, February 5, 2025.

Deputy Chief Justice Saldi Isra explained that the petition did not meet the formal requirements. Therefore, the Court declared the petition unclear and vague (obsuur libel).

“[The petition] fails to meet the formal requirements; therefore, there is no doubt for the Court to declare the petition unclear, vague, or obscuur,” said Justice Saldi in the plenary courtroom.

At the previous hearing, the Petitioners argued that the election had never taken place at the polling stations on November 27. “What happened on November 27 was that there was no voting process at all at the polling stations or in villages, leading to a significant difference between the Petitioner and candidate pair 1, who received a large number of votes,” said the Petitioner’s legal counsel Ishak Semuel Ronsumbre in panel 2 courtroom. Deputy Chief Justice Saldi Isra presided over the hearing alongside Constitutional Justices Ridwan Mansyur and Arsul Sani.

The Paniai Regency Elections Commission (KPU) has certified the vote results. Candidate pair 1 Yan Piet Nawipa-Ham Yogi as Relevant Party with 54,763 votes, candidate pair 2 Rooby Kayame-Hengki Kudiai as Petitioners with 10,761 votes, candidate pair 3 Nason Uti-Jhon Deki Yogi with 24,894 votes, candidate pair 4 Thomas Yeimo-Yeri Adii with 23,516 votes, and candidate pair 5 Ottopianus Gobai-Deki Nawipa with 1,516 votes. However, the Petitioner argued that their votes should have been 44,921 votes, considering some votes had been omitted or not included in the D-result form. This applied in several districts, including Aradide, Bogobaida, Ekadide, Youtadi, Aweida, Bibida, Nakama, East Paniai, Siriwo, Teluk Deya, Topiyai, Wegebino, and Yagai.
