JAKARTA (MKRI) — The Paniai regent-vice regent candidate pair 2, Robby Kayame and Hengky Kudiai, argues that the election never took place in the polling station on November 27 as revealed in the preliminary hearing of the Paniai regent election result dispute of case No. 291/PHPU.BUP-XXIII/2025 on Monday, January 13, 2025.
“What happened on November 27 was that there was no voting process at all at the polling stations or in villages, leading to the significant difference of the Petitioner’s votes with the candidate pair 1 who received a large number of votes,” said the Petitioner’s legal counsel, Ishak Semuel Ronsumbre in panel 2 courtroom. Deputy Chief Justice Saldi Isra chaired the hearing with Constitutional Justices Ridwan Mansyur and Arsul Sani.
The Paniai Regency General Election Commission (KPU) has certified the vote results. Candidate pair 1 (Yan Piet Nawipa-Ham Yogi) with 54,763 votes/the Relevant Party, candidate pair 2 (Rooby Kayame-Hengki Kudiai) with 10,761 votes/the Petitioner, candidate pair 3 (Nason Uti-Jhon Deki Yogi) with 24,894 votes, candidate pair 4 (Thomas Yeimo-Yeri Adii) with 23,516 votes, and candidate pair 5 (Ottopianus Gobai-Deki Nawipa) with 1,516 votes. However, the Petitioner argued that their votes should be 44,921 votes considering some votes were omitted or not included in the D-result form. This applies in several districts, including Aradide, Bogobaida, Ekadide, Youtadi, Aweida, Bibida, Nakama, East Paniai, Siriwo, Teluk Deya, Topiyai, Wegebino, and Yagai.
The Petitioner claimed that they filed a complaint to the Paniai Regency Bawaslu on December 9, 2024, alleging the violations committed by the Respondent at the polling committee (PPS), regional election committee (PPD), and the district elections supervisory (Pandis) levels who did not execute the election properly, causing the differences in the number of votes for candidate pairs 2 and 1. On December 11, 2024, the Paniai Bawaslu issued a recommendation to cancel the Paniai KPU’s vote result recapitulation plenary meeting in its entirety.
In response to Bawaslu’s recommendation, the Paniai KPU held a plenary meeting on December 13-14, 2024. On December 14, Bawaslu issued a letter detailing violations in voting, vote counting, and vote count recapitulation, including the absence of D-result forms from 24 districts, to be used as comparison data in the plenary meeting of the vote count results recapitulation at the Paniai regency KPU level. Bawaslu also recommended the Paniai KPU to annul the recapitulation due to these violations, which KPU Paniai failed to do according to the Petitioner.
In the petitum, the Petitioner requests the Court to annul the Paniai Regency KPU Decree No. 48 of 2024 on the certification of the Paniai regent-vice regent election result dated December 14, 2024. Additionally, the Petitioner wishes the Court to declare the correct votes as follows: candidate pair 1 (Yan Piet Nawipa-Ham Yogi) with 16,131 votes, candidate pair 2 (Rooby Kayame-Hengki Kudiai) with 44,921 votes, candidate pair 3 (Nason Uti-Jhon Deki Yogi) with 23,963 votes, candidate pair 4 (Thomas Yeimo-Yeri Adii) with 24,330 votes, and candidate pair 5 (Ottopianus Gobai-Deki Nawipa) with 6,079 votes. Alternatively, the Petitioner requests the Court to order Paniai Regency KPU a revote at 230 polling stations in 24 districts and 164 villages of Paniai Regency, Central Papua. (*)
