Obscure, Petition on Biak Numfor Regent Election Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) declared the petition for Case No. 158/PHPU.BUP-XXIII/2025 regarding the Biak Numfor regent election results dispute inadmissible. The ruling on the petition, filed by Candidate Pair 3, Saint Benhur Mansnandifu and Yohan Anthon Kho, was delivered during the ruling hearing chaired by Chief Justice Suhartoyo on Wednesday, February 5, 2025.

In its legal considerations, delivered by Deputy Chief Justice Saldi Isra, the Court explained that the petition did not fulfill the formal requirements, thus the Court did not hesitate to declare the Petitioners' petition to be vague or obscure.

For that reason, the remaining exceptions, the response from the Respondent and the statements from the Relevant Party and Bawaslu, and the petition's subject matter were not considered by the Court.

"On the other exceptions and for the remainder, [the Court] did not consider them any further since they have no relevance," Deputy Chief Justice Saldi Isra stated.

At the preliminary hearing on January 15, 2025, the Petitioners argued violations by candidate pair 1 Markus Octavianus Mansnembra-Jimmy Carter Rumbarar Kapissa (the Relevant Party) involving the Biak Numfor Elections Commission (KPU).

The Petitioner’s legal counsel, Febrina Aulya Rabbani stated that the Respondent used the Citra Damai motorboat, owned by a campaign team member of the Relevant Party on November 24, 2024. Febri also stated that this motorboat was to distribute election logistics to five districts in Numfor Islands: East Numfor, West Numfor, Foiru, Bruyadori, and Orkeri. Febri argued that using this motorboat constitutes a violation by the Relevant Party involving the Respondent in the regent election. Article 35 paragraph (1) of KPU Regulation No. 12 of 2024 stipulates that the Respondent should only collaborate with the Government, local government, national police, and armed forces to distribute and guard the election logistics.
