JAKARTA (MKRI) - The Constitutional Court (MK) granted the request to withdraw the petition on the 2024 Mamberamo Raya regent election results dispute, submitted by Candidate Pair 04 Alfons Sesa and Yakobus Britai (Petitioners). The Decree No. 286/PHPU.BUP-XXIII/2025 was read by Chief Justice Suhartoyo on Wednesday, February 5, 2025. At the ruling hearing held in the plenary courtroom, he stated that based on the justice deliberation meeting on January 31, 2025, it was concluded that the withdrawal of the Petitioners’ petition was legally justified.

“[The Court] determines, grants the withdrawal of the petition for Case No. 286/PHPU.BUP-XXIII/2025, declares the petition withdrawn. The Petitioners cannot re-file the petition, and [the Court] orders the Registrar’s Office to return petition copies to the Petitioners,” he said at the ruling hearing, alongside Deputy Chief Justice Saldi Isra and the other seven constitutional justices.

At the preliminary hearing on Wednesday, January 15, 2025, the Petitioners argued that the KPPS (polling station working committee) members had carried out polling in a way to resemble the noken* system on November 27, 2024. Hence, a recommendation for revote at TPS 1 of Papasena Hamlet was issued by the Mamberamo Hulu voters supervisory committee (Panwaslih). Subsequently, the Respondent issued Statement Letter No. 235 of 2024 on the assignment of revote at several polling stations in Waropen Atas, Mamberamo Hulu, Rufaer, Central Mamberamo, and East Central Mamberamo Districts. While the revote was scheduled on December 6, it was only implemented on December 7, 2024. Yet, a similar incident occurred at TPS 1 of Papasena II Hamlet, Mamberamo Hulu District.

Therefore, the Petitioners requested the Court to annul the Mamberamo Raya Regency KPU (Elections Commission) Decree No. 250 of 2024 on the certification of the regent election results, to disqualify Candidate Pair 1 Robby Wilson Sumansara–Kevin Totow from the election, and to order the Respondent to conduct a revote at all polling stations in the regency.
