JAKARTA (MKRI) — The Constitutional Court (MK) declared the petition for the dispute over the 2024 South Barito regent election results by Candidate Pair Number 02 Juana and Tini Rusdihatie (Petitioners) inadmissible. The Decision No. 273/PHPU.BUP-XXIII/2024 was read out by Chief Justice Suhartoyo at the ruling hearing on the dispute over the 2024 South Barito regent election results on Wednesday, February 5, 2025.
In the legal consideration read out by Constitutional Justice Daniel Yusmic P. Foekh, it was stated that after examining the testimony and evidence filed by the Parties, the Court was of the opinion that Vice Regent Candidate Number 3 Khristianto Yudha was proven to have finished serving his prison sentence on June 13, 2015. So, the five-year gap period was completed on June 13, 2020. Therefore, continued Justice Foekh, Khristianto Yudha had had more than five years to adapt in the community.
Therefore, according to the Court, the five-year grace period was no longer relevant, because it serves as a criterion for any person to be considered to have returned to community after serving a criminal period of 5 (five) years or more.
“Likewise, the Court views the requirement for Khristianto Yudha to announce the candidate’s status honestly and openly about his background as a former convict is also irrelevant to apply because it has the same essence as the applicability of the five-year grace period,” explained Justice Foekh.

Vice-Regent candidate 03 of South Barito Regency Khristanto Yudha was found legally guilty of narcotics possession and sentenced to 5 years and 6 months in prison, as determined by the Supreme Court. The Petitioners requested the Court to annul the South Barito Regency KPU (Elections Commission) Decree No. 1250 of 2024 concerning the certification of the 2024 South Barito Regency election results.
The Petitioners mention the acquisition of the vote as follows: Candidate Pair 01 Pe’i–Ina Prayawati received 12,701 votes, Candidate Pair 02 (the Petitioners) received 11,231 votes, and Candidate Pair 03 Eddy Raya Samsuri–Khristianto Yudha received 41,443 votes. However, the Petitioners believe that the vote acquisition of Candidate Pair 03 is not valid.
Because the vice-regent candidate registration requirements were not fulfilled as per Article 7 paragraph (2) letter g of Law No. 10/2016, as further outlined in Article 4 paragraph (1) letter f and paragraph (2a) of the KPU Regulation No. 1 of 2020. Therefore, the vice-regent candidates have failed to meet the eligibility criteria for nomination and should therefore be disqualified from participating in the 2024 South Barito Regency election.
