JAKARTA (MKRI) – Vice-Regent candidate 03 of South Barito Regency Khristanto Yudha was found legally guilty of narcotics possession and sentenced to 5 years and 6 months in prison, as determined by the Supreme Court. This statement was presented by Candidate Pair 02 Juana-Tini Rusdihatie at the preliminary hearing for the 2024 South Barito Regency election results dispute to the Constitutional Court (MK). The hearing for Case No. 273/PHPU.BUP-XXIII/2025 was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Foekh and M. Guntur Hamzah on panel 1 on Monday, January 13, 2025.
Reading the petition’s subject matter, the Petitioners’ legal counsel M. Rizky Hidayat requested the Court to annul the South Barito Regency KPU (Elections Commission) Decree No. 1250 of 2024 concerning the certification of the 2024 South Barito Regency election results regarding the votes as follows: Candidate Pair 01 Pe’i–Ina Prayawati received 12,701 votes, Candidate Pair 02 (the Petitioners) received 11,231 votes, and Candidate Pair 03 Eddy Raya Samsuri–Khristianto Yudha received 41,443 votes.
However, the Petitioners believe that the vote acquisition of Candidate Pair 03 is not valid because the vice-regent candidate registration requirements were not fulfilled as per Article 7 paragraph (2) letter g of Law No. 10/2016, as further outlined in Article 4 paragraph (1) letter f and paragraph (2a) of the KPU Regulation No. 1 of 2020. Therefore, the vice-regent candidates have failed to meet the eligibility criteria for nomination and should therefore be disqualified from participating in the 2024 South Barito Regency election.
“For the sake of upholding the Constitution and justice, the Court must annul the South Barito Regency KPU decree regarding the certification of the vote count recapitulation results of the 2024 South Barito Regency election,” explained Rizky from the plenary courtroom.
Therefore, the Petitioners requested the Court to order the South Barito KPU to disqualify Candidate Pair 03 Eddy Raya Samsury-Khristianto Yudha and to give sanctions to other parties related to the Court’s decision to comply with it.
