Bintan Election Dispute Dismissed Due to Obscure Petition

JAKARTA, MKRI - The Constitutional Court (MK) declared the petition for the dispute over the 2024 Bintan regent election results filed by Komunitas Bakti Bangsa inadmissible. Decision No. 217/PHPU.BUP-XXIII/2025 was read out by Chief Justice Suhartoyo accompanied by eight other Constitutional Justices in the ruling hearing on Wednesday, February 5, 2025.

In a legal consideration delivered by Deputy Chief Justice Saldi Isra, the Court stated that the petition did not fulfill the formal requirements necessary for submission. Therefore, the Court had no hesitation in declaring the Petitioner's petition unclear, vague, or obscuur.

Justice Saldi said that because the Court was of the opinion that the Petitioner's petition was vague, other exceptions, the respondent's response, the relevant party’s statement, Bawaslu’s statement, and the subject matter of the petition were not considered further.

“The arguments other than and the rest are not considered further because they are considered irrelevant,” stated Justice Saldi.

The Bakti Bangsa Community (Petitioner) argued that Candidate Pair 01, Roby Kurniawan and Deby Maryanti, had committed structured, systematic, and massive (TSM) violations, particularly by distributing basic necessities during the election. As evidence, the Petitioner cited the distribution of door prizes, including an electric motorbike, during the Golkar Party's anniversary celebration in Bintan, which was deemed to have unfairly benefited Candidate Pair 01 while disadvantaging the Petitioner.

Based on these alleged violations, the Petitioner requested the Court to disqualify the candidate pair and annul all stages of the 2024 Bintan regent election process.
