JAKARTA (MKRI) – The Bakti Bangsa Community (monitoring institution) filed a petition for the annulment of the Bintan Election Commission (KPU) Decree No. 622 of 2024 on the certification of the 2024 Bintan regent election vote count recapitulation to the Constitutional Court (MK). The preliminary examination hearing for Case No. 217/PHPU.BUP-XXIII/2025 on the 2024 Bintan regent election results dispute took place on Friday, January 10, 2024, presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
The Bakti Bangsa Community (Petitioner), represented by its legal counsel Agung Ramadhan Saputra, argued that Candidate Pair 01 Roby Kurniawan and Deby Maryanti had engaged in structured, systematic, and massive (TSM) violations, particularly by providing basic necessities during the election. Based on these violations, Agung requested the Court to disqualify the candidate pair and annul all stages of the 2025 Bintan regent election process.
It should be noted that the Petitioner is not the candidate, as the Bintan regent election was contested by only one candidate pair against blank votes.
The Petitioner objected to the vote results certified by the Bintan Election Commission (KPU), which declared Candidate Pair 01 as the elected pair with 49,430 votes, alleging structured, systematic, and massive (TSM) violations involving the provision of basic necessities. The Petitioner presented evidence of door prize distributions during the 60th anniversary celebration of the Golkar Party in Bintan, which were deemed to unfairly benefit Candidate Pair 01 and disadvantage the Petitioner.
"In the a quo activity, door prizes were also distributed to the community, one of them was a motorbike," Agung delivered the petition argument.
The Petitioner referred to Regional Election Law Article 71, paragraph (1), which prohibits candidate pairs from providing money or other materials to influence voters, and paragraph (2), which allows for the disqualification of candidate pairs found guilty of such actions.
The Petitioner further argued that Candidate Pair 01 should be disqualified due to the regent candidate's son-father relationship with Riau Governor Ansar Ahmad. According to the Petitioner, this connection raises concerns about potential bias and misuse of campaign resources, violating Article 76, Paragraph (1) of the Regional Election Law. To support this claim, the Petitioner mentioned the distribution of door prizes, including an electric motorbike, during the Golkar Party's anniversary celebration as evidence.
"The MC announced that the motorbike prize was provided by the governor. Therefore, we asked Candidate 01 Roby Kurniawan to give such an electric motorbike prize." Agung added.
