JAKARTA (MKRI) — The Constitutional Court (MK) approved the withdrawal of the petition for case No. 299/PHPU.BUP-XXIII/2025 regarding the dispute over the 2024 Tolikara regent election results filed by Candidate Pair Number 3 Dinus Wanimbo and Gamael Eldorando Enumbi. The decree was read out by the Chief Justice Suhartoyo alongside the other eight constitutional justices at a ruling hearing on Tuesday, February 4, 2025.
“[The Court] adjudicates, approves the withdrawal of the Petitioners’ petition No. 299/PHPU.BUP-XXIII/2025. [The Court] declares the a quo petition withdrawn, [and] that the Petitioners may not re-file the petition,” said Chief Justice Suhartoyo.
While delivering the legal considerations, Constitutional Justice Enny Nurbaningsih stated that based on the legal facts and the provisions of the laws, the justice deliberation meeting (RPH) on Thursday, January 30, 2025 concluded that the request to withdraw was reasonable according to law.
"[The Court rules that] the Petitioners cannot re-file the a quo petition and orders the Registrar’s Office to return the petition copies to the Petitioners." Justice Enny concluded.

Initially, the Petitioners in their petition mentioned that the vote difference between them and Candidate Pair 4 had been declared as 16,789 votes. They argued that this gap resulted from the fact that six districts—Wugi, Kembu, Yuneri, Nunggawi, Aweku, and Air Garam—out of the 46 districts in the regency had failed to complete the vote count recapitulation by the deadline set. In their petitums, the Petitioners requested that the Court order the Tolikara KPU (Election Commission) to conduct a revote in eight districts.
