JAKARTA (MKRI) – The Constitutional Court (MK) granted the Petitioners’ request to withdraw the petition for the 2024 Keerom regent election results dispute. The decree for the petition’s withdrawal, filed by regent-vice regent candidate 01 Petrus Solossa and Mustakim HR, was delivered on Tuesday, February 4, 2025, in the plenary courtroom.

“[The Court] grants the withdrawal of the Petitioners’ petition for Case No. 226/PHPU.BUP-XXIII/2025,” said Chief Justice Suhartoyo.

Constitutional Justice Enny Nurbaningsih explained that prior to the pronouncement of the decree, the nine constitutional justices had held a deliberation meeting on January 30, 2025. The meeting concluded that the request to withdraw the petition was legally justified, and the Petitioners were not permitted to refile the petition.

In the withdrawn petition, the Petitioners stated that within six months of the regent election, incumbent regent Piter Gusbager had transferred state civil apparatus (ASN). The Petitioners had lodged a complaint with Bawaslu (Elections Supervisory Body), but by the time the a quo case was filed to the Court, no disqualification sanction had been imposed on the individual in question.

In the petitums, the Petitioners requested the Court to grant the entire petition and to annul the Keerom Regency KPU Decree No. 538 of 2024 concerning the amendment to the Keerom Regency KPU Decree No. 71 of 2024 concerning the certification of the 2024 Keerom Regency election results, and to disqualify Candidate Pair 02 Piter Gusbager–Daud from participating in the 2024 Keerom regent election.
