JAKARTA (MKRI) — The Constitutional Court (MK) issued a decree in absence for the petition on the 2024 Puncak regent election results dispute filed by M. Andrean Saefudin from election observer Sarekat Demokrasi Indonesia. The decree for Case No. 280/PHPU.BUP-XXIII/2025 was delivered by Chief Justice Suhartoyo alongside the other eight constitutional justices in the plenary courtroom on Tuesday, February 4, 2025.

Prior to the pronouncement of the verdict, Constitutional Justice Arief Hidayat mentioned that at a previous justice deliberation meeting (RPH), the Court had concluded to dismiss the petition. “[The Court hands down] a decree in absence for Case No. 280/PHPU.BUP-XXIII/2025,” said Chief Justice Suhartoyo.

In the petition, the Petitioner alleged that the General Election Commission (KPU) as Respondent distributed election logistics to all districts in Puncak Regency, allocating resources to each area. However, five districts—Wangbe, Beoga, West Beoga, East Beoga, and Ogamanim—experienced delays in receiving their election materials. These delays resulted in the postponement of the election in these districts, deviating from the schedule outlined in the KPU Regulation No. 2 of 2024, which specifies the stages and timeline for the 2024 regional elections, including those for governor-vice governor, regent-vice regent, and mayor-vice mayor. Consequently, the Petitioner contended that the Respondent’s actions constitute a violation of the legal provisions set forth in the aforementioned regulation.
