Danny-Iksan's Petition Not Under West Halmahera KPU's Decision

JAKARTA (MKRI) – The Constitutional Court (MK) stated that the Case No. 198/PHPU.BUP-XXIII/2025 on the 2024 West Halmahera regent election results dispute filed by Candidate Pair 2 Danny Missy-Iksan Husain. The verdict was delivered by all constitutional justices at the ruling hearing on Tuesday, February 4, 2025.

"The Court declares to not have the authority to hear the Petitioners’ petition," said Chief Justice Suhartoyo accompanied by eight other constitutional justices.

Constitutional Justice Ridwan Mansyur explained that the Court concluded that the Petitioners’ petition was not related to the Elections Commission (KPU) Decree on the certification of the West Halmahera regent election results. "Therefore, the Petitioners’ petition falls outside the Court's jurisdiction to adjudicate," stated Justice Ridwan.

The Petitioners requested that the Court annul the minutes of the vote acquisition results from each district in the 2024 West Halmahera regent election dated December 6, 2024, and requested annul the KPU Decree on the certification of the 2024 West Halmahera regent election results.

In the petitums, candidate pair 02 alleged the vote buying, civil servants (ASN) mobilization, and misuse of state facilities committed by candidate pair 03 Yames Uang-Djufri Muhamad. The Petitioners believed that such violations were considered structured, systematic, and massive which could have influenced the vote acquisition in the 2024 West Halmahera regent election. Based on the certification of the vote count results by the West Halmahera KPU as the Respondent, Candidate Pair 1 Juliche Dolfina Baura-Bustami Albaar won 7,736 votes, Candidate Pair 2 Danny Missy-Iksan Husain won 18,147 votes, Candidate Pair 3 Yames Uang-Djufri Muhamad won 28,781 votes, and Candidate Pair 4 Iskandar Idrus-Lusiany Inggilina Damar won 13,367 votes.
