JAKARTA (MKRI) — The West Halmahera regent-vice regent candidate pair 2 Danny Missy-Iksan Husain argued that the candidate pair 3 (Yames Uang-Djufri Muhamad) committed violations including vote-buying, mobilization of civil apparatus, and abuse of state facilities. The Petitioner claimed that the violations were structured, systematic, and massive (TSM), affecting the regent election votes.
“[We suspected that there is] vote buying from the West Halmahera regent-vice regent candidate Yames Uang dan Djufri Muhamad,” explained the Petitioner during the preliminary hearing of case No. 198/PHPU.BUP-XXIII/2025 in panel 2 courtroom, Tuesday, January 14, 2025. Deputy Chief Justice Saldi Isra chaired the hearing with Justices Ridwan Mansyur and Arsul Sani.
The said candidate pair, who are the incumbents with the most votes in the election (28,781 votes), allegedly committed violations that may annul their certification, according to the Petitioner.
The Petitioner stated that West Halmahera Integrated Law Enforcement (Gakkumdu) successfully conducted a hand arrest operation on massive vote-buying by the candidate pair 3 campaign team, with the value of Rp51.05 million. The Petitioner claimed that based on circulating photos and videos, the said candidate pair distributed cash between Rp200,000 and Rp400,000 to the West Halmahera communities during the election silence.
The Petitioner also added that the Central Loloda sub district head distributed chainsaws and cash to Aruku village communities to vote for candidate pair 3. For this reason, the Petitioner reported to the Election Supervisory Committee (Bawaslu), requesting a recommendation to disqualify candidate pair 3. The Petitioner also notified West Halmahera Police of the distribution. However, as of December 9, 2024, the police have not provided any leads.
Meanwhile, the West Halmahera KPU has certified the vote results: candidate pair 1 (Juliche Dolfina Baura-Bustami Albaar) with 7,736 votes, candidate pair 2 (Danny Missy-Iksan Husain) with 18,147 votes, candidate pair 3 (Yames Uang-Djufri Muhamad) with 28,781 votes, and candidate pair 4 (Iskandar Idrus-Lusiany Inggilina Damar) with 13,367 votes.
As such, in the petitum, the Petitioner requests the Court to: 1) annul the West Halmahera Decree on the certification of vote results; 2) disqualify candidate pair 3, Yames Uang-Djufri Muhamad for violating Article 1 point 18 of KPU Decree on the nomination of regent candidates; and 3) order the Respondent to conduct a revote in all polling stations of West Halmahera regency.
