Court Grants Withdrawal of Nunukan Regent Election Results Dispute Petition

JAKARTA, MKRI - The Constitutional Court (MK) granted the withdrawal of the petition of Candidate Pair Number 1 Andi M. Akbar Mattawang Djuarzah and Serfianus. The hearing to pronounce Decree No. 156/PHPU.BUP-XXIII/2025 in the dispute over the 2024 Nunukan regent election results was held on Tuesday, February 4, 2025.

“[the Court] granting the withdrawal of the Petitioners’ petition No. 156/PHPU.BUP-XXIII/2025,” stated Constitutional Court Chairman Suhartoyo in the ruling hearing in the Constitutional Courtroom, Jakarta.

Constitutional Justice Enny Nurbaningsih before reading the decree explained that nine constitutional justices had held a justice deliberation meeting on January 30, 2025. The meeting concluded that the petition to withdraw the case was legally grounded and the petitioners could not refile the petition.

The Petitioners said Nunukan Regency consists of 21 districts, 8 villages, and 232 villages which are included in one of the Regencies in North Kalimantan Province, in the 2024 Regional Head Election followed by 3 (three) pairs of candidates as follows; Candidate Pair Number 1 Andi M Akbar Mattawang Djuarzah and Serfianus (Petitioners), Number 2 Basri and Hanafiah, and Irwan Sabri and Hermanus.

According to the Petitioners, the margin in votes was caused because the Relevant Parties committed violations during the voting on November 27, 2024, at several polling stations. The violations included voters who were not registered as voters in the local election at polling station 01 Pa'Kebuan Village, East Krayan District, who were given the opportunity to cast their votes. This violation has been processed by the Election Supervisory Body of Nunukan Regency, but was not followed up by the KPU of Nunukan Regency to conduct a re-vote. (*)
