JAKARTA (MKRI) — Nunukan Regent-Vice Regent Candidate Pair Number 1 Andi M. Akbar Mattawang Djuarzah and Serfianus withdrew their petition on the 2024 Pasangkayu Regency election results dispute. This petition was withdrawn at the preliminary hearing for Case Number 156/PHPU.BUP-XXIII/2025 on Thursday, January 9, 2025 in panel 3 courtroom.

Sidang yang dipimpin oleh Ketua Panel Hakim 3 Arief Hidayat, Pemohon yang diwakili oleh Eko Saputra selaku kuasa hukum menyampaikan pihaknya telah melakukan penarikan permohonan.

At the hearing presided over by Constitutional Justice Arief Hidayat, the Petitioners, represented by Eko Saputra as legal counsel, withdrew the petition.

“Berdasarkan kehadiran kami hari ini hanya untuk menyampaikan bahwa kami telah mengajukan penarikan permohonan dan kami telah menerima tanda terima penarikan,” ujarnya.

“Today we attended the hearing only to convey that we have submitted a request for the withdrawal of the petition and we have received a receipt,” he stated.

Sebelumnya, dalam permohonanannya, Pemohon mengatakan Kabupaten Nunukan terdiri dari 21 kecamatan, 8 kelurahan, dan 232 desa yang masuk dalam salah satu Kabupaten di Propinsi Kalimantan Utara, dalam Pemilihan kepala Daerah Tahun 2024 diikuti oleh 3 (tiga) pasangan calon yakni Nomor Urut 1 Andi M Akbar Mattawang Djuarzah dan Serfianus (Pemohon), Nomor Urut 2 Basri dan Hanafiah, serta Irwan Sabri dan Hermanus.

In the petition, the Petitioners explained that Nunukan Regency in North Kalimantan Province consists of 21 districts, 8 urban villages, and 232 villages. Three candidate pairs competed in the election: Candidate Pair Number 1 Andi M. Akbar Mattawang Djuarzah and Serfianus (Petitioners), Candidate Pair Number 2 Basri and Hanafiah, and Candidate Pair Number 3 Irwan Sabri and Hermanus.

Menurut Pemohon, selisih perolehan suara disebabkan karena Pihak Terkait Melakukan Pelanggaran pada pemungutan suara tanggal 27 November 2024 di beberapa TPS. Pelanggaran tersebut di antaranya, terdapat Pemilih yang tidak terdaftar sebagai pemilih pada pemilihan setemnpat pada TPS 01 Desa Pa'Kebuan, Kecamatan Krayan Timur, yang diberikan kesempatan untuk memberikan suaranya. Pelanggaran ini telah diproses oleh Bawaslu kabupaten Nunukan, namun tidak ditindaklanjuti oleh KPU Kabupaten Nunukan untuk dilaksanakan PSU.

According to the Petitioners, the difference in votes was because of the violation committed by the Relevant Party during the election on November 27, 2024 at several polling stations (TPS). The violations included voters who were not registered as voters at TPS 01 Pa’Kebuan Village, East Krayan District. This violation was processed by the Nunukan Regency Bawaslu (Elections Supervisory Body) but was not followed up by the Nunukan Regency KPU (Elections Commission).

Untuk itu dalam petitumnya, Pemohon meminta MK untuk membatalkan Keputusan Komisi Pemilihan Umum Kabupaten Nunukan Nomor 2767 Tahun 2024 tentang Penetapan Hasil Pemilihan Bupati dan Wakil Bupati Nunukan Tahun 2024.(*)

In the petitum, the Petitioners asked the Constitutional Court to cancel the Nunukan Regency KPU Decree No. 2767 of 2024 on the certification of the Results of the 2024 Nunukan regent election.
