Court Grants Withdrawal of Malang Regent Election Results Dispute

JAKARTA (MKRI) — The Constitutional Court (MK) granted the Petitioners’ request to withdraw the petition for case No.138/PHPU.BUP-XXIII/2025 on the 2024 Malang regent election results dispute. The decree for the petition’s withdrawal, filed by regent-vice regent candidate pair 2 (Gunawan Hs and Umar Usman), was delivered by Chief Justice Suhartoyo with other eight Justices.

“[The Court] grants the Petitioners’ request to withdraw the petition,” said Chief Justice Suhartoyo delivering the verdict in the plenary courtroom on Tuesday, February 4, 2025.

The decree was the result of a justice deliberation meeting taking place on Thursday, January 30. The Court also ordered the Registrar’s Office to return the petition copies to the Petitioners.

The Petitioners argue that the candidacy of Sanusi (Relevant Party) as the 2024 Malang Regency Regent, despite receiving the most votes, is unconstitutional. This is because Sanusi is considered to have served two terms as regent: first, as the elected regent for the 2021-2025 period, and second, as the acting regent for the 2016-2021 period after initially serving as vice-regent. Sanusi replaced Regent Rendra Krisna, who was convicted of corruption in 2018 and sentenced to imprisonment. Therefore, the Petitioners requested his disqualification from the election.
