JAKARTA, MKRI - The Constitutional Court (MK) declared the petition of Candidate Pair Number 2 Alpian-Alfikriansyah inadmissible in the case of the dispute over the 2024 Pagar Alam City mayor election results. The hearing of the reading of decree No. 74/PHPU.WAKO-XXIII/2025 was presided over by Chief Justice Suhartoyo accompanied by eight constitutional justices, on Tuesday, February 4, 2025.
“In the main petition, [the Court] declares the petition inadmissible,” stated Chief Justice Suhartoyo in the Constitutional Courtroom, Jakarta.
Constitutional Justice Enny Nurbaningsih explained that the arguments relating to the alleged double voters and forged signatures have been followed up by the Pagar Alam City General Election Commission (KPU). In this follow-up, the Pagar Alam City KPU has clarified the issue and then resolved it at the polling station level.
The Petitioners received 29,231 votes and the Relevant Party received 33,672 votes. The difference between the two votes is 4,441 or 4.8 percent, which exceeds the 2 percent threshold in Article 158 paragraph 2 letter b of Law No. 10/2016 concerning the Election of Governors, Regents, and Mayors.
“The Court does not gain conviction and validity to the main arguments of the Petitioners’ petition. Therefore, to the a quo petition, there is no reason to postpone the application of Article 158,” stated Justice Enny.

The Court held a preliminary hearing of the dispute over the 2024 Pagar Alam mayor election results with Petition Case No. 74/PHPU.WAKO-XXIII/2025 on Wednesday, January 8, 2025. The petitioners, Alpian-Alfikriansyah, argued that there have been violations and fraud committed by the polling station working committee (KPPS) and district Election Committee (PPK), the violations occurred in all districts in Pagar Alam City, which then the violations were considered to have entered the realm of election crimes regarding falsification of state documents.
The alleged findings of administrative violations and election fraud were committed by the relevant party in the form of using data from the additional final voter's list (DPTB) conducted by KPPS at several polling stations.(*)
