Petitioners Claim Pagar Alam Mayoral Election Unprofessional

JAKARTA (MKRI) — The Court held a preliminary hearing of the Pagar Alam Mayoral Election Dispute with Case No. 74/PHPU.WAKO-XXIII/202. The Petitioner includes the Pagar Alam mayor-vice mayor candidate 02, Alpian-Alfikriansyah.

Constitutional Justice Arief Hidayat presided over the hearing with Constitutional Justices Enny Nurbaningsih and Daniel Yusmic P. Foekh.

In the petition, the Petitioner highlights the unprofessionalism of the city’s election organizer which affected the votes obtained. Such events allegedly occurred at the level of the polling station working committees (KPPS), subdistrict election committees (PPK), to commissioners of the General Election Commission (KPU) of Pagar Alam City, allegedly siding towards a candidate pair.

To note, three candidate pairs participated in the Pagar Alam Mayoral Election. KPU, as the Respondent, has issued a decree specifying result of votes for the three pairs: Hepy Safriani-Efsi (29,538 votes), Alpian-Alfikriansyah (29,231 votes), and Ludi Oliansyah-Bertha (33,672 votes).

The petition focuses more on violations and fraud committed by KPPS and PPK in all districts in Pagar Alam City, instead of vote result disputes. The petitioner argued that the organizers had conducted administrative issues, but these issues pertain more to the criminal activities in the election, such as the falsification of state documents.

“Overall, the violations include the final voters list (DPK) in several polling stations, which we suspected to be falsified and signed by KPPS head instead of the voters,” said Zeldi Dwitama as the Petitioner’s legal counsel in the panel courtroom 3, Wednesday, January 8, 2025.

The violations and/or frauds occurred in Pagar Alam City include the differences of special voters list (DPK) in North Pagar Alam subdistrict, especially that of gubernatorial election (350 voters) and mayoral election (342 voters).

“This DPK, which functions as an additional voter list, must use 2.5 percent of the reserved ballots as a formal requirement. At the time of the ballot box opening, there was no data associated with the DPK,” Zeldi said.

Moreover, the KPPS at polling station 8 of Beringin Jaya village, North Pagar Alam district, served voters using the resident ID of outside Pagar Alam City, and gave two types of ballots. The legal counsel stated that the voters from outside Pagar Alam City, without having the A-Form of voting relocation letter, cannot exercise their right to vote.

At polling station 6 of Bangun Rejo village, North Pagar Alam district, the KPPS signed the DPT attendance list of those who were absent. The same incident also occurred at polling stations 2, 3, 4, 6, and 8 of Ulu Lurah village, South Pagar Alam district, where there were indications of false signatures on the DPT attendance list.

The findings of alleged administrative violations and election frauds, Zeldi continued, should be suspected of using data from the additional final voters list (DPTb), which KPPS conducted in many polling stations. This is a violation of Article 52 paragraphs (2) and (3) of KPU Regulation No. 7 of 2024 on the Preparation of Voters Lists in the Organizing the Elections of Governor-Vice Governor, Regent-Vice Regent, and Mayor-Vice Mayor.

“This DPTb, based on the regulation, must attach the form of voting relocation letter. From what we found on the field, the witnesses did not find such forms when opening the ballot boxes,” said Zeldi.

In the petition, the Petitioner requests the Court to annul the Pagar Alam City KPU Decree No. 279 of 2024 on the Certification of the Election Results of the 2024 Pagar Alam Mayor and Vice Mayor, dated December 4, 2024. The Petitioner wishes the Court to order the Pagar Alam City KPU to conduct a revote in 48 polling stations across five districts in Pagar Alam.

“The Petitioner requests the Court to] order the KPU of Pagar Alam City to carry out this decision and/or should the Court decide differently, please make a fair decision,” said Zeldi. (*)
