Central Kalimantan Gubernatorial Election Dispute Withdrawal Granted by Court

JAKARTA (MKRI) — The Constitutional Court (MK) has made a ruling on the 2024 Central Kalimantan gubernatorial election results dispute on Tuesday, February 4, 2025. It decided to grant the Petitioners’ request to withdraw the petition filed by Candidate Pair 1 Willy Midel Yoseph–Habib Ismail Bin Yahya.

“[The Court] adjudicated, grants the withdrawal of the Petitioners' petition No. 269/PHPU.GUB-XXIII/2025, declares the a quo petition has been withdrawn and the Petitioners may not re-file the petition," Chief Justice Suhartoyo read out the decree.

While delivering the legal considerations, Constitutional Justice Enny Nurbaningsih stated that based on the legal facts and the provisions of the laws, the justice deliberation meeting (RPH) on Thursday, January 30, 2025 concluded that the request to withdraw was reasonable according to law.

"[The Court rules that] the Petitioners cannot re-file the a quo petition and orders the Registrar’s Office to return the petition copies to the Petitioners." Justice Enny concluded.

In their petition, the Petitioners said that the vote count results were certified by the Central Kalimantan KPU (Elections Committee) with a total of 1,300,490 valid votes. The difference in votes allowed in election results dispute, according to the provisions of Law No. 10 of 2016 is a maximum of 1.5% of the total valid votes, which is 19,507 votes in this case. However, according to the Petitioners, the difference in votes between them and the winning Candidate Pair Number 3 was 205,328 votes. In addition, the difference with Candidate Pair Number 2 was 149,899 votes.

The Petitioners argued that the success of Candidate Pair Number 3 Agustiar Sabran and Edy Pratowo happened due to structured, systematic, and massive (TSM) violations that involved the incumbent governor and vice governor, bureaucratic structures, heads of regional working units (SKPD), state civil apparatus (ASN), and directors and commissioners of regional-owned enterprises (BUMD). They were accused of abusing their authority by using government programs and activities to benefit themselves.
