JAKARTA (MKRI) - The Constitutional Court (MK) dismissed the petition on the 2024 Murung Raya regent election results dispute, filed by Candidate Pair 02 Nuryakin and Doni (Petitioners). The decision for Case No. 01/PHPU.BUP-XXIII/2025 was read by the Chief Justice Suhartoyo at the ruling hearing on Tuesday, February 4, 2025.
Chief Justice Suhartoyo clarified that the petition in this case did not meet the formal requirements. As a result, the Court had no hesitation in declaring the petition unclear or vague. Consequently, the Respondent’s and the Relevant Party’ exceptions, asserting that the petition lacked clarity, were deemed legally justified.
“[The Court] adjudicated, on the exceptions regarding the [Court’s] authority or deadline for filing the petition, on the petition’s subject matter: to declare the Petitioners’ petition inadmissible,” said Chief Justice Suhartoyo while reading out the verdict for this case in the plenary courtroom, alongside the other eight constitutional justices.

At the preliminary examination hearing on Monday, January 13, 2025, the Petitioners requested the Court to annul the Murung Raya Regency KPU (Elections Commission) Decree No. 861 of 2024 concerning the certification of the 2024 Murung Raya Regency election results dispute. They stated that the vote acquisition certified by the Murung Raya KPU (Respondent) as follows: Candidate Pair 01 Heriyus Midel Yoseph and Rahmantor Muhidin received 31,459 votes, while the Petitioners received 31,141 votes. However, the Petitioners argued that Candidate Pair 01 should have received 31,208 votes, and the Petitioners themselves should have received 31,392 votes.
The Petitioners argued that the significant difference in the vote count was caused by fraudulent practices committed by Candidate Pair 01’s campaign team, which were allegedly allowed by the Respondent. Additionally, the Petitioners claimed that there had been eight additional voters who were not eligible to vote in Murung Raya Regency.
Therefore, the Petitioners requested the Court to annul the Murung Raya KPU Decree No. 861 of 2024 concerning the certification of the 2024 Murung Raya Regency election results relating to the vote acquisition at the following polling stations: TPS 1, TPS 3, TPS 16, TPS 17, TPS 19, and TPS 21 of Beriwit Village, Murung District; TPS 1 of Danau Usung Village, Murung District; TPS 1 and TPS 2 of Masao Village, Sumber Barito District; TPS 1 of Sungai Lunuh Village, Tanah Siang District, TPS 1 of Nono Kliwon Village, Tanah Siang District, TPS 1 of Datah Koto Village, South Tanah Siang District; TPS 1 of Muara Untu Village, Murung District; TPS 1 of Bahitom Village, Murung District; TPS 2 of Muara Sumpoi Village, Murung District; TPS 5 of Muara Laung 1 Village, Laung Tuhup District; TPS 5 of Muara Tuhup Village, Laung Tuhup District, TPS 1 of Dirung Lingkin Village, South Tanah Siang District, TPS 1 of Tumbang Kunyi Village, Sumber Barito District; TPS 1 of Batu Makap Village, Sumber Barito District; and TPS 1 of Kalapeh Baru Village, Sumber Barito District.
