JAKARTA, MKRI - The Court (MK) held an examination hearing on Case No.178/PHPU.BUP-XXIII/2025 over the 2024 Dogiyai regent election results dispute on Friday, January 31, 2025. The hearing agenda was to hear the Respondent’s response and testimonies by the Relevant Party and Bawaslu (Elections Supervisory Body) and the hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1.

Bansawan, the legal counsel for Candidate Number 02 Yudas Tebai–Yuliten Anauw (Relevant Party), denied allegations that the Relevant Party had intimidated the Yametadi Polling Committee (PPS).

“There was never any intimidation committed by Candidate Number 2 against the Yametadi Polling Committee (PPS) or any transfer of noken/bundles of votes from the Petitioners to Candidate Number 2. The vote recapitulation in Yametadi Hamlet, Kamu Utara District, was conducted in accordance with the law and regulations, without any objections or records of special events until the results were finalized. The dispute arose long after the vote recapitulation and was merely a family dispute unrelated to the issue of vote acquisition,” explained Bansawan.

At the preliminary hearing on Thursday, January 16, 2025, the Petitioners requested the cancellation of the Dogiyai Regency KPU Decree No. 701 of 2024 concerning the certification of the 2024 Dogiyai regent election results. The Petitioners conveyed the votes of the candidate pairs according to the Respondent, as follows: Candidate Number 01 Ruben Magai-Mateus Douw received 7,944 votes, Candidate Number 02 Yudas Tebai-Yuliten Anauw received 41,900 votes, Candidate Number 03 Otopianus P. Tebai-Angkian Goo received 9. 618 votes, Candidate Number 04 Alfred Fredy Anouw-Orgenes Kotoki (Petitioners) received 23,407 votes, Candidate Number 05 Freny Anouw-Abni Auwe received 2,292 votes, and Candidate Number 06 Oskar Makai-Yani Bobi received 10,919 votes, with a total of 98,080 valid votes. Meanwhile, according to the Petitioners, there were differences in vote count according to the Petitioners version as follows: Candidate Number 02 Judas Tebai-Yuliten Anauw received 31,900 votes, and the Petitioners received 33,407 votes.

In Dogiyai Regency, the noken system was applied, so voting was carried out based on bundles of votes that should have been counted at the polling stations, but instead, the votes were conducted at the district election committee (PPD). This is reinforced by the existence of election logistics that have never been dropped off at the polling stations or KPP. From the information gathered from the Petitioners’ Witness, the campaign team of candidate number 02 took the logistics by force and then delivered it to the KPU. Therefore, the Petitioners request that the Court order the Dogiyai Regency KPU to conduct a recount of votes at the North Kamu KPP along the Yametadi Hamlet vote tie by returning the Petitioners’ votes taken by Candidate Number 02; order the Dogiyai Regency  Bawaslu to supervise the implementation of the recount of votes at the North Kamu KPP along the Yametadi Hamlet vote tie, especially in terms of supervising the return of the Petitioners’ votes taken by the Candidate Number 02.
