Maybrat Regent Election Revote Hampered by Voter Turnout

JAKARTA, MKRI - The Maybrat Regency KPU revealed the obstacles in the re-voting of the 2024 Maybrat regent election in one of the polling stations (TPS). KPU Maybrat as the Respondent in Case No. 234/PHPU.BUP-XXIII/2025 disputing the 2024 Maybrat regent election results, explained this in its response at the hearing on Thursday, January 30, 2025. The hearing was scheduled to hear the Respondent’s response and testimonies by the Relevant Party and Bawaslu (Elections Supervisory Body) as well as to validate evidence. The hearing was held in the Constitutional Courtroom (MK) presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel 1.

This case was filed by Candidate Number 1, Kornelius Kambu, and Zakeus Momao. The Relevant Party is Candidate Number 3, Karel Murafer and Ferdinando Solossa.

In the hearing, KPU Maybrat admitted that it had received two recommendations from the Maybrat Regency Bawaslu to conduct a re-voting. The first recommendation has been followed up with a re-voting at one polling station (TPS) on December 2, 2024.

Then the second recommendation was followed up with a re-voting at eight TPS on December 7, 2024. However, there were obstacles at one of the eight TPS, specifically TPS 001 Smuswioh Hamlet, Ayamaru District. This obstacle is in the form of zero voter participation in the re-voting.

“All the voters in the hamlet refused to participate in this re-voting,” stated the Respondent's legal counsel, Ahmad Tawakkal Paturussi.

The Respondent claims to have made various efforts in the re-voting at TPS 001 Smuswioh Hamlet Ayamaru District. This re-voting collaborates with the security forces and Bawaslu Maybrat. The Respondent Party has also extended the re-vote time.

“The Respondent has extended the election time, but still the voters who are registered in the DPT (permanent voter list) of TPS 001 refuse to attend the re-voting on December 7, 2024,” Ahmad stated.

In addition to the re-voting issue, the Respondent also addressed the Petitioners’ arguments regarding problems at 51 TPS, where there was a double permanent voter list (DPT) and the use of voting rights by individuals who had passed away but were still recorded as voters. According to the Respondent, the Petitioners should have provided more detailed explanations by including a list of names, DPT serial numbers, and death certificates for each voter who was considered deceased.

The Respondent also argues that the Petitioners’ witness should have noted this on the Model C Special Occurrence Form.

“The Petitioners’ witness also did not record any objections to the district-level recapitulation in the Special Occurrence Model D,” asserts Ahmad.

The problems at the 51 TPS were also highlighted by the Relevant Party, who delivered a statement in the same hearing. Just like the Respondent, the Relevant Party also considered that the Petitioners did not specify its allegations regarding the double permanent voter list (DPT) and the use of the voting rights of deceased people who still registered as voters.

“The Petitioners only made assumptions because they did not mention the names, ages, and addresses of the people who were named as doubles in the permanent voter list (DPT),” stated the Relevant Party's legal counsel, Abd Latif Lestaluhu.

The Relevant Party also responded to the argument of the Petition which alluded to structured, systematic, and massive (TSM) violations involving hamlet heads and state civil apparatus (ASN). The Relevant Party considers that this issue should be explained in more detail.

“Which hamlet head, and in which hamlet, which civil servant, and in which agency collaborated with the Relevant Party, and in what way and how it was influenced, and how the votes flow to the Relevant Party,” asserted Latif.

Bawaslu Maybrat as the Provider of Information revealed the results of supervision during the 2024 Maybrat regent election. So far, there have been 12 reports and one finding obtained by Bawaslu Maybrat. Of the 12 reports, five recommendations were issued. Among these recommendations, there were eight re-voting conducted by the Respondent.

“Everything has been followed up by the KPU. Only one polling station whose DPT or voters did not exercise their voting rights, TPS 01 Ayamaru District,” stated the Head of Bawaslu Maybraat, Isai Asmuruf.

Meanwhile, four other reports were not followed up because they were deemed not to fulfill the elements of an election offense.

For information, the issue of the double final voters list (DPT) was highlighted in the Petition. According to the Petitioners, the double DPT problem occurred in 51 TPS across 15 districts. The issue also involved individuals who had passed away but were still recorded in the DPT and even voted. Additionally, the DPT problem in this case was related to the rights of voters who were not present at the polling stations on voting day.

The abuse of voting rights, according to the Petitioners, was committed by various parties, including the hamlet head, district head, and polling station working committee (KPPS) members. According to the Petitioners, these parties voted repeatedly, they also cast on the ballot papers belonging to the voters who were not present at the location on voting day.
