Intan Jaya KPU Rejects Allegation of Recapitulation Errors

JAKARTA (MKRI) — The Intan Jaya Regency Elections Commission (KPU) as the Respondent denied the allegation of voting recapitulation errors in eight districts. Their legal counsel Fakhriy Ilmullah stated the allegation was based on assumptions and baseless.

“The Respondent has conducted the regent election following the regulations, including the final voters list (DPT) determination, logistics distribution, voting process, and the recapitulation of the vote results, all were in accordance with the regulations,” said Fakhriy in the plenary courtroom on Thursday, January 30, 2025.

He delivered the statement at the hearing for Case No. 301/PHPU.BUP-XXIII/2025 to hear the Respondent’s response, testimonies by the Relevant Party and the Elections Supervisory Body (Bawaslu), and to validate evidence. Constitutional Justice Arief Hidayat presided over the hearing, accompanied by Constitutional Justices Anwar Usman and Enny Nurbaningsih.

Fakhriy also added that they had reviewed the Petitioners’ evidence (P-7 to P-14) in the form of copies of C-results forms. He asserted that the allegation of vote recapitulation errors failed to meet the evidence validity criteria under Article 44 paragraph (2) of the Constitutional Court Regulation No. 3 of 2024.

“[The reason was] C-result forms were taken by the community or supporters of candidate pairs before the polling station working committee (KPPS) had completed them. This is aligned with the fact that the Intan Jaya Bawaslu issued an advisory letter No. 268 dated December 3, stating that the district election committee (PPD) must base the recapitulation on the D-result forms on field facts agreed upon by the community. If the C-results forms were unavailable or unstamped and had issues, the recapitulation should refer to field evidence,” said Fakhriy.

Candidate Pair 1 Aner Maisini-Igapa are the Relevant Party. Their legal counsel, Leonardus S. Sagala, stated that the Petitioners had failed to prove the alleged vote recapitulation errors in eight districts and who had been involved.

“The Petitioners’ a quo argument was false and factually unfounded. The vote results certified by the Respondent at the regency level matched the results at the district level,” Sagala added.

“If the Petitioners’ votes had been deflated and the Related Party’s increased in all districts, the candidate pairs’ witnesses should have objected. However, the Petitioners’ witnesses did not object during the recapitulation at the district level or the plenary recapitulation of Intan Jaya Regency on December 12-14, 2024 in Nabire,” he continued.

In this case, the regent-vice regent Candidate Pair 3 Apolos Bagau-Tetairus Widigipa are the Relevant Party. Justice Arief Hidayat inquired about their involvement, considering their votes in the regent election were only ranked third.

Their legal counsel, Joshua Riodoma, disputed the Intan Jaya Regency KPU Decree No. 1042 on the certification of the 2024 regent-vice regent election results on December 14, 2024, and a social media post on December 16, 2024. Joshua stated that no candidate pair witnesses had been present at the certification of the said recapitulation results.

“Even if there had been [a candidate pair witness], the Relevant Party strongly suspected the Respondent had conspired with a certain candidate pair to secure the victory in the 2024 Intan Jaya regent election,” explained Josua.

Intan Jaya Regency Bawaslu member Otniel Tipagau stated that they had issued recommendation No. 277 on December 13, 2024 regarding re-recapitulation and data verification in the districts of Agisiga, Tomosiga, Hitadipa, Wandai, and Ugimba. This recommendation was followed up and implemented by the Intan Jaya Regency KPU.

“Meanwhile, in Ugimba District, data verification was not carried out, as the district supervisory committee (PPD) and district committee were not present,” said Tipagau.

Furthermore, Intan Jaya Regency Bawaslu sent recommendation No. 279 on December 16, 2024 to cancel the certification of the vote recapitulation results until all election result documents are submitted transparently, including the data verification from the districts of Ugimba, Agisiga, and Hitadipa.

“The Intan Jaya Regency KPU refused to cancel the certification of the vote recapitulation results in Intan Jaya Regency,” he said.

The Intan Jaya Regency Bawalsu also sent an advisory letter on December 16, 2024, recommending the Intan Jaya Regency KPU to arrange a delayed recapitulation schedule. “Finally, based on the supervisory results of Intan Jaya Regency Bawaslu at the district level recapitulation, the results of the candidate pairs were stipulated as follows: Candidate Pair 1 with 43,535 votes; Candidate Pair 2 with 24,995 votes, Candidate Pair 3 with 19,098 votes, Candidate Pair 4 with 20,672 votes, and Candidate Pair 5 with 15,884 votes,” Otniel explained.

Candidate Pair 5 Bernadus Kobogau-Melianus Agimbau as the Petitioners argued the errors in vote count recapitulation in eight districts, including Sugapa (from 3,688 to 1,084 votes), Homeyo (from 7,262 to 1,378 votes), Biandoga (from 14,030 to 6,808 votes), Hitadipa (from 8,395 to 200 votes), Ugimba (from 7,102 to 3,000 votes), Tomosiga (from 5,142 to 1,292 votes), Wandai (to 99 votes), and Agisiga (from 2,061 to 2,023 votes).
