JAKARTA (MKRI) — Candidate Pair 5 Bernadus Kobogau-Melianus Agimbau (Petitioners) have petitioned the annulment of the Intan Jaya KPU (Elections Commission) Decree No. 1042 of 2024 issued on December 14, 2024 for the indications of errors in vote count recapitulation that hurt their vote acquisition in several districts.
The preliminary hearing for Case No. 301/PHPU.BUP-XXIII/2025 was presided over by Constitutional Justice Arief Hidayat (panel chair) and Constitutional Justices Anwar Usman and Enny Nurbaningsih on panel 3 on Wednesday, January 15, 2025. There were five candidates competing in the election: Candidate Pair 1 Anner Maisini-Igapa acquired 43,535 votes, Candidate Pair 2 Marten Tipagau-Malianus Belau 24,995 votes, Candidate Pair 3 Apolos Bagau-Tetairus Widigipa 19,908 votes, Candidate Pair 4 Oni Dendegau-Aguni Tapani 20,672 votes, and Candidate Pair 5 Bernadus Kobogau-Melianus Agimbau 15,884 votes.
The Petitioners’ legal counsel Stefen Alves Tes Mau argued that the recapitulation error resulted in mistaken vote difference with Candidate Pair 1 in five districts based on the D-result forms from Agisiga, Tomosiga, Hitadipa, Wandai, and Ugimba Districts. At the same time, the votes for Candidate Pair 1 went up.
“In the five districts discrepancies were found between the plenary result forms at the district level with the C-result-copy forms,” Tes Mau asserted.
“We have grounds to suspect the district election committee (PPD) had intentionally removed D-result forms at the district level for the interest of Candidate Pair 1,” he continued.
There were also indications of vote purge against the Petitioners in eight districts, which are Sugapa District (from 3,688 to 1,084 votes), Homeyo District (from 7,262 to 1,378 votes), Biandoga District (from 14,030 to 6,808 votes), Hitadipa District (from 8,395 to 200 votes), Ugimba District (from 7,102 to 3,000 votes), Tomosiga District (from 5,142 to 1,292 votes), Wandai District (to 99 votes), and Agisiga District (from 2,061 to 2,023 votes).
Alleging vote purge, the Petitioners argued that the Intan Jaya KPU had committed structured, systematic, and massive (TSM) violations for harming and benefiting certain candidate pairs. “In the Petitioners’ count based on C-result-copy forms, the Petitioners should have acquired 47,779 votes in the eight districts,” Tes Mau explained.
In their petitums, the Petitioners requested that the Court annul the Intan Jaya Decree No. 1042 of 2024 on the certification of the regent election results dated December 14, 2024. They also requested that the Court order the KPU to conduct a recount or matching the data of C-result forms at the polling stations against the recapitulation results in Sugapa, Homeyo, Biandoga, Hitadipa, Ugimba, Tomosiga, Wandai, and Agisiga Districts.
Alternatively, they petitioned that the Intan Jaya KPU conduct a recount or matching the data of C-result forms in the polling stations against the recapitulation result in five districts, namely Agisiga, Tomosiga, Hitadipa, Wandai, and Ugimba Districts. Lastly, they requested that the Court order the Intan Jaya KPU to conduct recount or matching the data of C-result forms at the polling stations against the recapitulation result in three districts, namely Agisiga, Hitadipa, and Ugimba Districts.
