Jakarta, MKRI - The period and term of office of Ade Sugianto in the 2024 Tasikmalaya Regent Election Result Dispute is considered not to be an issue by the Tasikmalaya General Election Commission (KPU). This was conveyed in the hearing case no.132/PHPU.BUP-XXIII/2025 on Friday, January 17, 2025, with the agenda of Listening to the Respondent's Answers, Relevant Party Statements, and Bawaslu.

The hearing was presided over by Chief Justice Suhartoyo (panel chair) and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on panel court room 1. The Petitioners are Candidate Number 2 Cecep Nurul Yakin and Asep Sopari Al-Ayubi. The Relevant Party is the Candidate Pair Number 3 Ade Sugianto and Iip Mipathul Paoz and The Respondent is the Tasikmalaya KPU.

To answer the argument of the petition in the previous hearing, The Tasikmalaya KPU expressed its stance by explaining the calculation of the period and term of the office of regent based on the date of the inauguration, this calculation is based on the General Election Commission Regulation (PKPU).

“So, the KPU's stance refers to The General Elections Commission Regulation (PKPU) as a positive law. What counts is since the inauguration, so what applies is [the date] since the inauguration,” said Ali Nurdin, the legal counsel of the Tasikmalaya KPU.

Ali explained that the Relevant Party, Ade Sugianto, served his first term from December 3, 2018, to March 23, 2021, a duration of 2 years, 3 months, and 20 days. Meanwhile, in the second term, based on the results of the 2021 Tasikmalaya Regency Regional Head Election, there are no issues concerning the Relevant Party’s term of office.

In line with the Respondent, the Relevant Party through its legal counsel also asserted that there were no issues regarding the period and tenure as Tasikmalaya Regent. Therefore, the Relevant Party fulfills the requirements to be able to participate in the 2024 Regent Election.

The issue of tenure in 2016, in which the Regent of Tasikmalaya, Uu Ruzhanul Ulum, was appointed as The Deputy Governor of West Java, did not necessarily make Ade Sugianto, the Deputy Regent become the Regent. According to the Relevant Party, this is reflected in the absence of a decree (SK) declaring him to be the Regent or Acting Regent.

“So until the period of September 5 to December 3, there was no Decree from the Ministry of Home Affairs that stated Ade Sugianto as the Acting Regent. And all the proposal letters from the DPRD until the Governor of West Java, in [all the letter] the nomenclature is the Deputy Regent,” stated Tanda Perdamaian Nasution.

From the answers filed by the Respondent and the Relevant Parties, both request the Court to declare the correctness and validity of the Certification of The 2024 Tasikmalaya Regent election result of KPU Decree No. 2689 of 2024. 

Meanwhile, The Bawaslu of Tasikmalaya Regency as the Provider of Information, confirmed that there was no report on the issue concerning the period and the term of office of the Relevant Party. Bawaslu Tasikmalaya also confirmed that there were no violations that occurred in the 2024 Tasikmalaya Regent Elections.

“Regarding periodization, there is no report and recommendations [to the Bawaslu]. The point is the results of our supervision [Bawaslu], the Tasikmalaya Regency KPU has implemented PKPU Number 8 of 2024 concerning the Nomination of Regent and Deputy Regent,” assert Tasikmalaya Bawaslu Chairman Dodi Juanda.
